“We’ve learned that federal prosecutors here in New York City, not Bob Mueller and his team in Washington, D.C., career prosecutors here in New York City, have evidence that the president of the United States committed a felony by ordering and paying Michael Cohen to break the law,” the judicial analyst said. “How do we know that? They told that to a federal judge.”
“Under the rules, they can’t tell that to a federal judge unless they actually have that hardcore evidence,” he continued. “Under the rules, they can’t tell that to a federal judge unless they intend to do something with that evidence.”
..
“The felony is paying Michael Cohen to commit a felony,” Napolitano concluded. “It’s pretty basic.”
Well. When Fox news lays it out like that. While I suspected that was the case, he seems certain that it's necessarily the case.
SDNY, you go left, House Dems take right, Mueller, you're with us straight down the middle?
So what's their plan, sealed indictment? Try to toll it? Word is even SDNY won't try to indict a sitting president, policy is policy.

Tolling it seems the most likely to happen, though technically speaking the DOJ could simply decide to reverse their policy and indict him anyway, though it certainly wouldn't result in Trump's arrest. But if I had to bet a crispy ten dollar bill on the former or the latter then I'm definitely putting it on the former.
I haven't hard much about tolling, I've been missing news a lot. DOJ I suppose won't be doing that, it would look like they were out to get Trump. Which is true, but not for the reasons right-wingers would cry until the end of time about.
AFAIK, tolling is not something prosecutors do. It is the result of circumstance
..reading. Apparently in a civil case it happens, but since it hasn't been applied to this sort of situation, with criminal charges, it seems like it's up in the air. Seems crazy to assume they can, get to that point, it's challenged, and be told they can't.

No, Trump has not been convicted of a felony and if the dirty prosecutors and judges do try and convict him it will be only by an unjust kangaroo court. Trump can spend his own money like he chooses in spite of the vicious claims to the contrary.
Yeah, the confidence and simplicity of Napolitano’s remark struck me too.Wow, I'm surprised to hear this from FOX News.
And it's so simple even Trump cult members can understand.
If A pays B to commit a felony, it's the same as if A committed the felony himself. Our president is a felon.
I agree, and I certainly hope that ultimately overshadows this in terms of criminal liability for Trump. But as a matter of the rule of law, if he’s guilty of a felony, it’s necessary that justice be served. And if we can’t serve justice, I feel we should be outraged and use it as an opportunity to consider how this might be remedied in the future. But personally, I think his business with Russians while promoting Russian interests is far more troubling and a real danger to national security.
I can’t that seriously. No, Trump has not been convicted of a felony and if the dirty prosecutors and judges do try and convict him it will be only by an unjust kangaroo court. Trump can spend his own money like he chooses in spite of the vicious claims to the contrary.

Interesting that you're calling prosecutors and judges "dirty" when it was Donald Trump who was committing adultery with porn stars and paying a lawyer to cover it up.

I can smell the desperation.Funny..... you mean federal prosecutors have never bent the truth in court? What about all the lies told to the FISA court? And Michael Cohen would say most anything to keep his punk butt out of jail which did not work.
Trump will be president till 2020....

Well, that's what he should have done. He should have written the porn stars a check. But that's not what he did. He hired people to do it for him, create fake companies and fake names, etc etc. He had AMI buy a story to keep it quiet.
Do we really want to condone politicians paying people to keep quiet about things that may hurt their chances of being elected? Don't voters have a right to know and vote based on the truth? And aren't you concerned that a politician is then beholden to the people keeping his secrets?
