Oh, so following and talking someone is now an offensive act that one should protect themselves from, with violence? Private detetives beware...LOL!!!

he followed him in his car. he followed him on foot. these are provocative acts. all in the dead of night.

Martin had every reason to feel threatened by this.

I'm walking on a dark street. A car is slowly following me. And I'm walking. [/b]Then a guy gets out of his car and comes towards me.[/b] And I'm walking. [/b]Then the guy approaches me[/b] and I'm scared. I ask why he's following me. [/b]He asks what I'm doing there.[/b] A scuffle ensues. I'm dead.

Anyone who cannot see the ambiguous nature of this encounter just isn't trying hard enough. Martin did not make the first move. Unless you're counting "walking home in the dark with Skittles and iced tea."

So far, I see no grounds for assault.

Perhaps. And that was certainly stupid. If so, a young and stupid kid was being stalked and harassed by a wannabe that had been TOLD by the police to stop stalking him and harassing him...and the kid is dead. This isnt all that crazy and convoluted. Basic math. Who was the responsible agent? The 'adult' playing neighborhood watch superhero.

Where was the threat? Following someone isn't exactly a threatening act.

Could it be that Martin was going to, "show that white boy a thing, or two"? "ain't no cracka' motha-****a gonna shadow my ass, ****".

Based on the circumstances described, I'd say Zimmerman has no case for shooting Martin. Florida law is clear that an individual may resort to deadly force to counter deadly force. Getting punched in the nose by an unarmed teenager is not deadly force.

Try to look at it with NO emotion for a sec....

I believe, the majority of jurisdictions follow this guideline...where deadly force can only be used when reasonable to protect person from deadly force or threat of serious bodily harm (life, limb, or bodily function.) in the majority of courts you don't have to retreat ****. A minority of courts require you to retreat if the ability to do so is present.

But whats reasonable? That is up to the jury (or a judge in some circumstances.) The jury looks at whether a reasonable person in the same situation as the defendant, would have reasonably believed death or serious bodily injuy was eminant to defendant or others he was defending

Getting punched in the nose probably to you is not a big deal, but perhaps Zimmerman thought Martin had the ability, opportunity and intent to do so....

Only if that person assaults you first. Simply being stalked--love how he was being stalked vice followed BTW--isn't a physical threat.

How, what are you going to do? We have lots of old folks in neighborhood crime watch around here, moreso as burgaries and assaults go up likely due to collapsing economy and this largely a middle to upper middle class area in some parts.

OK, you;re walking down the street - wasn't this like 2 am or something, I can't remember. You see a car slowly following along behind you. You see that, turn, walk towards the person in the car following you, see that person is talking on a cell phone. You then turn again and quickly run around behind one of his neighbor's houses.

He gets out and follows you. You stop, turn still again and say "why are you following me?!" He says, "What are you doing around here?!"

Now, what are you going to do? Run at him, slugging him in the face, knocking him down and maybe start kicking him as he screams "somebody help me!"

Is that what you mean by "defend yourself?"

Somehow, beating the hell out of that guy doesn't seem very legal for asking what you're doing poking around his neighbor's house at 2 am. And, somehow, I suspect if that old guy has a gun in his pocket he's going to shoot you in the chest to stop you kicking or punching him anymore.

What am I missing in your explanation of what you'd do? And how that is likely to end?

LOL...asking someone questions doesn't justify assault. What if the guy had been asking directions and Martin took a swing at him?

Can you possibly see how you're argument doesn't hold water?

and that means that if you approach me in any way, fist will be hitting cartilage.

...hypothetically, of course.
