Since you can't provide any evidence that he did, and Flynn never even claimed that he did, you already have your answer.

I wonder how Judge Sullivan is taking this, he requested the pertinent documentation, the 302 was withheld, and the day before he holds a sentencing hearing the prosecution belatedly turns in the 302, plus this report from Mueller summarizing his conclusions and evidence.

I would expect any judge to be upset the prosecutor didn't produce the evidence at the outset, this is why Sullivan issued that order from the court requiring the 302 within a week, then the prosecutor complies, but holds back the most relevant document and now on the verge of the hearing, turns up with the missing document. At the very least, Flynn's counsel would be entitled to review the 302 and Mueller's summary.

Prosecutors are supposed to provide the accused with all "exonerating evidence", if the accused can show the prosecutor didn't provide all the exonerating evidence the prosecutor had, the court is supposed to dismiss the charges. The fact Strzok was fired for impropriety directly related to the prosecutor's case against Flynn, is exonerating evidence and Mueller didn't tell Flynn. The destruction of evidence relating to that impropriety by the prosecutor is highly suspicious, as is the late delivery of this 302.
 
When I read your posts, I read a person who is strategizing to bend-over-backwards to have Trump evade law enforcement, no less than Al Capone's lawyers did -- not a person who gives a damn about their country. You deflect from criminal activity and claim law enforcement, not the person being charged with criminality, is the problem.

Seems obviously false to me. That's been the excuse of every aristocrat and monarch in history, more or less. Service, understood properly, is not an exchange--I give you this service and then you do something for me. That's work. Service is doing something without any expectation of any special privilege or reward, and as far as I can tell, Flynn deserves none.

Anyway, also as far as I can tell, Flynn was never in a place where he could "die for us." He was a senior commander in Iraq and Afghanistan; the only time he was actually anywhere close to real fighting was in Grenada, and even had he been killed there, that could hardly have been described as "dying for us."

The Miranda warning is only required when a suspect is actually taken into custody. The police can question you all they want, without giving any sort of warning first. This happens all the time, it is 100% normal.

Plus, Flynn used to be the head of the DIA. He absolutely knew that lying to the FBI was a crime. He did it anyway, he was caught, he pleaded guilty. The idea that he is an innocent naif is delusional.


Uh, hello? Mueller gave the court the original 302s. Those documents, by the way, show that he knew why he was being question and yeah, he lied about it.

As to Congress? Get real. In addition to the ridiculous escapades pulled by "Detective Nunes," Congress leaks like a sieve. Both parties leak, we've seen it happen over and over. The FBI/DOJ is going to tell Congress the absolute minimum.

Lol, no such distinction exists in the real world. Anything you say to a LEO while in custody can be used against you. You know like lies you might use when talking to an FBI agent, or lies about being a foreign agent...

Hey even I warmed up on her a little as SOS until Benghazi. Then I found out about her secret private server and all the lies that came out with that can of worms. Trump was the only choice to keep her out of office. I just don't like how the Left is trying to sandbag his administration.

The agents each identified themselves for Flynn and reiterated what it was they were there to discuss before the interview was begun. No question Flynn understood the nature of the discussion.

Steven Portnoy is reporting that after giving Flynn multiple chances to walk back the guilty plea, Sullivan basically unleashed the Kraken. Sounds like Sullivan was furious that that Flynn lied to the FBI in the White House, and sold out his country. He asked the prosecutors if they considered charging Flynn with treason, and is talking about jail time.

I'm gonna go out on a limb and say yeah, Sullivan is over it.

1) I'm not even sure this case got to the discovery phase. Flynn flipped almost immediately.

2) The original 302 supports the FBI's claims and the guilty plea.
 

No, I am saying that we treat everyone equally....If we are going to require that the least of criminals be informed of their rights before they are left open to incriminating themselves, then so should have Flynn...I'm not arguing that he should have, or would have known better. That is irrelevant. The fact of the matter is, it sure seems like they came close to, if not violated his rights.

You're absolutely right....He did choose poorly...And after this, NO ONE should ever talk to prosecutors, or FBI without a lawyer present, no matter how they try to say it will be easier without one.
 

Michael Flynn was the director of the DIA. He was NS advisor. He has multiple lawyers paid to be there whenever he needs them.

Do you think he doesn't know his rights?

We don't know what he is looking at....Seems Sullivan is not too happy with Flynn at the moment, and now Flynn is asking to delay sentencing, so he can testify in another matter....So, it looks like Flynn's people are thinking that the judge is NOT going to accept the prosecutions recommendation of 0 time....
