Man Jailed for Making Fun of Girl with Cerbral Palsy

An eastern Ohio dad accused of mocking a 10-year-old neighbor girl with cerebral palsy must serve 29 days in jail and pay a fine in connection to the disgraceful display, a judge has ordered.
The actions of William Bailey, 43, of Pike Township, were caught on video by the girl’s family, sparking widespread outrage over the perceived bullying. He pleaded no contest Tuesday to downgraded offenses from the original fourth-degree disorderly conduct and first-degree aggravated menacing charges filed last month, according to The Repository.
The menacing charge is related to an incident in which the girl's mother claims Bailey threatened to choke the mother with a chain, the newspaper said.

A municipal court judge found him guilty, and Bailey must report to the Stark County Jail in January and pay $400 in court costs and fines.

You know what this guy did is despicable. The first thing my mother taught me after she spied me innocently looking at a war veteran with no legs was to tell me that I should never stare at people who were cripple, and who it was obvious had something wrong with them. It was a lesson I never forgot, and I taught it to my girl friend's daughter as well. This guy is teaching his kid to be just another jerk like himself. But that's where I draw a line in the sand. Since when has making fun of people become a crime? I grew up with other kids taunting me over how I walked or what clothes I happened to wear to school that day. Come on, get real. This happened in Cincinnati, but I don't think this town is any different from any other American city.
 
If I'd been the parents of the girl, I would have voluntarily gone to jail for beating the wholly **** out of him.

I work with DD adults and used to work with DD children. I get extremely protective of those who cannot defend themselves and I can honestly say, most of the most brutal pricks to people with DD are grown adults.

Maybe sending this douche to jail will send a clear message:

Don't be a douche.

One cannot go about threatening children with violence against their family. That's definately illegal.

I'm still trying to figure out what law he broke. There doesn't seem to be a "don't be a dick or douche" law in Ohio.

I would go further as part of his community service (under guard of course) he should work at a respite facility or a 'residence" for 6 months.

the Americans WIth disabilities act is very clear that demeaning or degrading a DD person or MI person "with harmful intent" is a misdemeanor. So I guess this must be part of it. But Not sure.

did the man take any physical action, get into the girls face, was he own other people's property, ....or did he just say some things people didn't like.

understand... i am not taking any side, i am asking what did he really do, and what is the criminal charge.

because these things can be dangerous, if you charge people, for just saying what they think.

Being a douche cannot be illegal. It's a free country. I understand well the anger at such an ass; but we must uphold the lofty goals of freedom if we aim to keep it.

I doubt this is one of those cases. The Dude's on video, probably mocking the poor girl's mannerisms. You know that his lawyer would have received a copy of the video and he watched himself as others see him. He was also likely mean enough to have told the child that he was going to choke her Mother with a chain.

All the prosecutor had to do was threaten to put the vid on youtube. 29 divided by three is only 10 days in the pokie. That should be enough to at least make him never do it again. Most county jails are **** holes.
 
There is a victim (the girl) and a witness (the mother).

Menacing is a crime. Menacing a child or a senior is an even more serious crime.

I wish TD or Tigger had been there. They would have scraped this guys remains off the lead.

You asked which law he may have broken I gave you a possiblity. And by the way ADA does not stop at the workplace. Its the "with harmful intent" part that is the real key. the problem is probably for a jury in such a case - What does that mean?

i have no doubt, this guy, is a jerk, ...all i am concerned about is if he had, just mocked her and that is all.

just mocking cannot be a crime, because it is free speech, and free speech is always speech someone does not like.

threats are a crime, and can land you in jail.

The laws he was charged with breaking. He wasn't charged with an ADA violation and your assertion you can go to prison for mocking a disabled person is highly suspect.

True. However, I believe harassment might fall under a law in which this 'man' broke.
 
Seems there was bad blood between the families who used to be friends.

In any event, he is 43, and obviously a complete douche.

The folks on the internet will make his life miserable.

He can drop by my house anytime - it's like the Hotel California - he can check out, but will never leave.......

Looks like the first degree aggravated menacing charge was for threatening to choke the Mom. Without having all the details it looks like they charged him with everything they could forcing him to plea down or else he could have faced the close to 200 day prison sentence just for the one misdemeanor charge (in Ohio law).

The fourth degree misdemeanor (disorderly conduct) was likely over his action towards the girl which in ohio could have added another 30 days and a nice fine.

That's how I read it at least :shrug:
