Willfull intent isn't needed in mishandling of confidential email. Grossly negligent in handling of classified emails is only needed to violate the law.

Using a personal email account for government business is not illegal for advisers, but they are supposed to forward all such emails to their government accounts so they can be made available to the public.

Cabinet positions require confirmation by Congress in which she is not a member of any. The President can appoint advisors as he sees fit, as he is the President. You want to say she's not an advisor yet want her to abide by all the rule for which an advisor must follow, you can't have it both ways. She was an official advisor to the President, get over it.
