It's Time To Arrest Ultra-Orthodox Jews Who Delay Flights Over Seating [W: 66] (1 Viewer)

Arrest them? That's ridiculous - they haven't broken any laws. Kick them off the flight? If they can't be accommodated by having someone else exchange seats, they then refuse to sit down in their assigned seats, and begin to delay the flight, kick their butts off and let 'em swim to Israel. If a drunk guy refused to sit down, he would be escorted off the flight in a heartbeat.
 
Arresting people for being asinine is pretty asinine.

Arrested? Not here in the US. They would be escorted off the flight. If they act up after they leave the gate, then they can be charged with a crime - 49 U.S. Code § 46504 - Interference with flight crew members and attendants

The way I understand the law, if the aircraft is still at the gate, the "flight" has not officially begun, and that is why they kick people off the flights, but don't have them arrested.

I may be wrong, but I fly a heck of a lot, and have seen this happen a number of times, and have had the flight crew and cops that responded explain to me what the law actually says. That's why I knew how to get you the citation, as well.

Why the difference? This has to do with safety of the other passengers. One or a couple of people regardless of sex, race and religion should not be able to delay the rest unless it is a medical emergency.

It depends on what the airline/police see the situation as. Regardless as far as I know not one of these situations with Hassidic Jews refusing to sit next women, has ever resulted in them being escorted off the airplane.

The plane is sitting on the ground not moving. What safety issues are you talking about?

The danger to other passengers would be involved after the airplane moves and would be a larger issue after takeoff. But as to the delayed starting the engines? That does not really result in any danger. Do you think?

I've never heard of them being kicked off either. At the very least, that's what they should start doing. El Al may not choose to, but Delta or American Airlines or any other airline flying from the US (JFK in NY in this instance) to any other airport in the world, including Tel Aviv's Ben Gurion Airport, should kick them off if they refuse to sit down.

IMHO, this would also go for any other religious person of any other religion that may have a problem sitting beside a woman that is not a family member.

I guess my only point is, if the plane hasn't left the gate, then kick them off, but I see no reason to have them arrested unless they cause a ruckus or get violent - then I would say lock them up.

FYI - 49 U.S. Code § 46501 - Definitions

In this chapter—

(1) “aircraft in flight” means an aircraft from the moment all external doors are closed following boarding—
(A) through the moment when one external door is opened to allow passengers to leave the aircraft; or

(B) until, if a forced landing, competent authorities take over responsibility for the aircraft and individuals and property on the aircraft.

That's where the law put's the line, after the door closes and before the door opens, then the plane is in-flight and the flight crew MUST be obeyed. Before the door closes, there's less of a legal level which I would related to less of a danger therefore less of a criminal type act.

Its amazing that in this day and age a flight full of people cant make a simple accommodation for a few individuals. This would have taken...what...30 seconds to resolve ahd the aircraft not been full of apparently bigoted angry hate filled little ****heads that would rather sit on a tarmac for an hour than move a few seats.
