So, after an anonymous call of a man with a gun at a Buffalo school, SAFE Act supporter, hypocrite, and overall douchebag Dwayne Ferguson was sought after on school grounds for carrying a holstered firearm in a school zone, when given the opportunity to tell officers he had the firearm he did not and it was only found after a patdown of his person. This jackass wasted police resources and inconvenienced others because he couldn't even own up to the very standard he supposedly wants to impose on others.

Throw the book at him, give him the maximum, and make sure there is no early release or clemency.

I can't feel any sympathy for this guy, he directly lobbied against our rights and got caught breaking the very law he lobbied for. The guy is worse than a hypocrite and I can't see anyone more deserving of being punished by this, even if I disagree with the law, to me, this is no worse than a guy training a dog to be a killer and having it turn on him.

It seems that the SAFE Act makes carrying on school grounds a mandatory felony. Good riddance to the SOB.
 
Conviction on a felony gun charge will permanently make him a gun grabber advocate - after all, what has he got to lose now, since his personal gun rights are forever gone? This is the big problem with all absolute (zero tolerance) laws - a felony resulted without any criminal intent what so ever.

Yeah he had no criminal intent but really I don't feel comfortable with guns near or at schools... I come from vietnam which has extremely strict gun laws so the idea of being allowed to carry a firearm is scary to me but I can see the benefits even if it makes me uncomfortable.... nothing bad would of happened to him if he just followed the laws he supports right? so it's kind of his fault in my eyes

He already was a lifelong anti-second advocate so it's really a zero sum here. If anything at least he'll be quiet for about five to ten years.

There is a major problem with a lot of firearms and drug laws in the U.S. intent is not accounted for, they are zero tolerance laws and the burden of proof is shifted more to the defendant than the arresting authorities which goes against the very legal foundations of our country.

I had a huge laugh at it when I ran across it as well. Figured our side would love this one, and it's yet another example of "do what we say not what we do", it's like the argument that only police and the military should own guns, then the theater shooter a few weeks ago turns out to be a retired officer, and the NYC brothers who were police caught in an illegal trafficking bust.

Love it! It speaks to so many core arguments from our side, intent, willingness to follow laws, motives of the grabbers, and their utter hypocricy.

It's an E felony - the lowest class of felony in NYS. 1-4 years is the sentencing guideline. He probably won't even do year.

In other news one of the magazine restrictions - the one that said 10 round mags could only be loaded with 7 seven rounds - was ruled unconstitutional by a Federal District Court judge in Buffalo. That was another piece of stupidity. The original version of the law capped handgun magazine size to 7 rounds. No one bothered to check whether people actually make 7 round magazines (most popular semi automatics do not have a 7 round option). So they backed off on that and said you can keep the 10 round mags but could only load 7.

Unfortunately the judge ruled the rest of the act is constitutional. Both sides are appealing.

Even the large bore pistols like .45s have an 8 round magazine. I don't know what those elected officials are smoking but they all need to be drug tested.

The only one I think I know of with 7 round magazines are the .45 Colt 1911 variants. I'm pretty sure my dad's Colt Gold Cup has a 7 round mag. But his is also 30 years old and they may have changed since then

There are a few pistols that do have lower than 8, especially those made for concealment. However a good bit of the modern .45s have a capacity of 8 including the newer 1911 models. The "standard" configuration is 7+1 but most newer models are 8+1, a few customs are 9+1 IIRC.

The Keltec P32 is 7+1. The .380acp version is 6+1.

Absolutely, and they should get more time, afterall they know the law due to their positions. If not, their ignorance is inexcusable because it's their job to know.

Fair enough but here's the problem for CCW permit holders. Usually we have our handguns well out of sight, and secure. If we have to remove the weapon to go to a school, park, or whatever, it gets left in the car, which can be much easier to be stolen by.... the kids at the school, passersby, etc. Anyone who decides to smash and grab or steal your car, now has a weapon as well. This I know because I was burgled and had left my gun at home in a lock box because I was going to the university campus for quite some time. During that time my home was burgled and a teen boy got my lock box, bashed it open and then had a really deadly Glock. Had I been carrying, that weapon would've been secure and not stolen.

It's my opinion that CCW holders should be able to carry anywhere, but the penalties should they screw up should be enhanced severely since they should know better than anyone the proper and legal use of firearms.
