First, what is the difference between this fine and the Obamacare fine? I don't see one. If you don't buy liability insurance, you're fined. If you don't buy healthcare insurance, you're fined. Tax/Fine/Tax/Fine -- either way it's the same.

Secondly, why is this in the Federal government's purview? Seems to me this is a state issue.

Thirdly, I would hope SCOTUS would see this as an end run around our rights.

Of course, law enforcement and government officials are exempt.

That is what personal liability insurance is for.

Do they really think a person who is going to committ a Sandy Hook type shooting spree is going to worry about having insurance?

Another penalty for legitimate gun owners is all it is.

I doubt it will make it to the Surpreme Court, because this proposal is already dead in the water.

Not everyone would have to buy it, so it's a not mandated purchase.


Regardless of that it shouldn't be up to Congress - it should be left with the states.

I think you're going to need to purchase liability insurance just in case someone steals your neighbor's gun and while escaping uses it while climbing your fence to get away. You clearly didn't protect your property from stray guns and must suffer the consequences.

Same as car insurance I would imagine. You have to show proof of insurance when you register the car (buy the gun) and if you're ever caught without the insurance you get fined - just like they check for carry permits if they find someone carrying. :shrug:

Actually, it will be a mandated purchase for anyone that owns a gun and since it doesn't apply to everyone, it's possible that it doesn't fall under the definition of a tax.

What if I bought a gun in the past? Not that I have, mind you, just in the circumstance that somebody had done so.

Guns are generally covered as property under homeowners insurance policies if they're lost or stolen. Courts have held that gun accidents are subject to a homeowners' liability insurance unless they are specifically excluded. Criminal acts aren't covered by any insurance. Can't buy it.
 
They're going after guns like they did cigarettes. Rather than just outlaw them they tax, regulate and make it miserable to use them. I think it's a chicken**** way of trying to eliminate a legal product.

They just need to repeal any laws that protect gun dealers and owners from law suits. When you sell a gun to a criminal w/o doing some type of background check, you should be open to criminal and civil liability. That would include a criminal trafficker who sells your gun to a gang banger who kills three people. You should be sued for wrongful death.

Don't like it? Go to your local gun store and pay for a background check before selling your gun.

And take your little "infringed" trump card and stick it. SCOTUS doesn't see background checks as anything by reasonable safety.

It sure seems like a dumb idea. I like the idea of "gun insurance" if there is such a thing. It seems like the sort of thing you'd want if you're a "law abiding" citizen. Of course Democrats have no power in the house, so they can propose any dumb idea they want and it won't pass. That's the beauty of being in the opposition.

People drive around all the time without car insurance. When they get caught they pay the fine. :shrug:
