I didn't respond because the only part of the comment I disagree with is your use of the word "coup." Civil authority still governs the state and the city. The courts are still up and functioning.

What she described was the federal government "rescuing" the city from its duly elected officials. With the military. Sounds like a coup to me.

The military is protecting federal property and ICE agents as they perform their statutory duties.

ICE agents are armed. They don't need any more protection, and if they do, bring more ICE agents. Or FBI. It's illegal to use the military.

Any person they might detain is turned over to local or federal law enforcement and not held for a military tribunal.

The federalization of the National Guard and the deployment of active duty forces is a statutory and constitutional dispute now on appeal. (To be heard this Tuesday.)

It's obvious to a casual observer that Trump hasn't met any of the conditions required by law.

This is what's dangerous. The law doesn't empower POTUS to make this decision. It's up to the states. The statute specifically deals with federal law. If the governor refuses to act on federal law - if Newsom activated the guard to surround the federal building, preventing ICE from entering, for example - then I believe the stature would apply. This LA protest and small riot don't satisfy the condition.

If POTUS held the power to deem any violence an insurrection necessitating troops on the street, then there is no check against troops on every street in the country.

Did the governor request federal assistance as required by statute?

He didn't.

The appeals process and decision may well be the most significant result arising from this mess.

Trump's argument hasn't been in showing how the conditions in LA satisfy the text of the law. The argument is that POTUS, and POTUS alone has the power to declare and define an emergency. Once Trump declares an emergency, it's out of the court's hands. I don't think the courts are eager to relinquish their constitutionally equal power.
