(CNN) -- The family of a Florida man has released video of his death, hoping to get criminal charges filed against the police officer who ran him over.
On May 8, Marlon Brown was being chased by DeLand police because they allegedly saw that he was not wearing a seatbelt. At a dead-end road, Brown stopped his car and started running.
One of the police cars hit and ran him over, its dashcam video recording the entire incident.
Last week, a grand jury decided not to indict officer James Harris on a criminal charge of vehicular manslaughter. That's when the family decided to go public, and release the video.
"We knew it wasn't going to be an easy video to watch," says Krystal Brown the ex-wife and mother of Brown's children, "but in order to obtain justice, and that's what we're looking for, we knew it was something that we had to do."

Hard to say considering CNN left out the moments before impact. If the driver was attempting to stop, and skidded over him, then it could be accidental. My guess is the grand jury viewed the unedited footage and thought the same.

Strange seeking a vehicular homicide charge. If you read the statute, its clearly not intended for police pursuit. If thats the case, then every cop that chases would be subject to reckless driving charges.

I've seen the unedited footage of the tape, he most certainly did NOT break. He aimed his car straight for the man, going around the other police vehicle which was doing the right thing and maintained his speed through impact and stopped on top of him. And he was fired for it. I've sat on a grand jury. They are rubber stamps for the prosecution.

Personally, I don't think it matters if it was accidental. If he was using his vehicle to chase someone who is on foot and is unable to keep control of it, he's responsible for what happens as a result.

See he was a NON violent criminal. Out side of the fact that he was willing to probably run down anyone that tried to stop is escape from police. For a seat belt fine. Which is I think $125.00 now.
The lives of your family to that man was worth $125.00, and he was willing to kill them for it.
Now his family will be millionaires thanks to the state of Florida.

Which is why the other officers patrol car stopped and he began to peruse him on foot the moment the suspect took to foot. That was proper procedure.

yeah the link is posted now and of course i cant be certain either because it could be one of those instances where the gas was hit on accident in a panic or he threw his car in neutral and hit the brake.

The family of Marlon Brown, the Fla. man killed after being run down by a police car, has filed a complaint accusing the medical examiner's office of "negligence" and "material misrepresentation of the data" after it ruled the death was an accident

Officer Harris was fired immediately after his chief viewed the video on May 31, but State's Attorney R.J. Larizza did not indict Harris on charges of vehicular homicide, which in Florida is defined as "the operation of a motor vehicle by another in a reckless manner likely to cause the death of, or great bodily harm to, another."

Instead, Larizza gave the case to a grand jury, which declined to press charges.

Brown family attorney Benjamin Crump tells CBS News' Crimesider that he believes the reason the grand jury failed to indict Harris was that the autopsy, signed by Dr. Marie Herrmann, determined that there was no evidence the car struck Brown - a conclusion the family's complaint says defies "logic, common sense, and seemingly scientific principle."

Herrmann's report said Brown wasn't hit by the patrol car. It says he was killed by "mechanical asphyxiation" because he was pinned under the car with his head bent down so far that he was unable to breathe.

On the family's side is James Cusack, the funeral director who prepared Brown's body. At a news conference on Thursday, Cusack said Brown had injuries not indicated on the medical examiner's report.

"I saw an indication that his neck, was very loosely-where you could move it- which to me, was there were some contusions, if not a complete break," said Cusack.

Wow so the large thump in the video wasnt his head smashing off the car and then when the car "rested on top of him" it must of just gently been placed there it didnt strike him there . . . .

Trying to stop from high speeds on grass and dirt really sucks sometimes. Stupid idiot should not of caused the chase in the first place. Should not of been fired or charged. Maybe given some remedial driving training. Killing a piece of **** criminal during the commission of crime should never be made illegal.

Would you please quit rearranging my posts. If I wanted them to look like bullets in a power point slide, I would put them that way.

A criminal engaged in a felony, in the case presented felony evasion which endangers the public, is by my definition a piece of ****. I have zero sympathy for any who get killed while committing a crime. Killing a felon, who gives a damned, damage to a public vehicle while engaged in official duties, hardly something to fire someone over.
