The SCOTUS order was to effect his return and treat him as if he had not been deported to El Salvador. He has an outstanding deportation order good for any other country except El Salvador.

Guilty or not he'd be subject to deportation. If he was released on bail he'd be subject to immediate deportation. Which is why his lawyers are scrambling to withdraw their motion for bail.

The court didn’t see proof he was involved in any gang activity and his status only requires he file a waiver an I 130 is a petition for immediate relatives it isnt an I 485

Inaccurate information can be corrected, and paperwork can be filed late. This just isn't a problem.
