Officer Byrd violated her civil rights

he could have warned her
he could have pushed her back
he could have tasered her
but shooting her was excessive force

She was warned.

Pushing her back as the Mob followed her through? Instant fail.

Taser? The Mob would have followed her through. Instant fail.

She never posed an imminent threat to anyone, which is the correct standard when considering lethal force.
Well, sure, if you ignore the facts that she was part of a larger angry, violent mob who broke into the Capitol and fought with police. Some of whom were calling for the deaths of the vice president and House Speaker. Byrd believed he had heard gunshots shots in the House chamber, heard "officer down" over the radio, law enforcement standing next to him being threatened to let the mob into the House chamber with, "we don't wanna hurt you." It wasn't just her he was up against. He was up against a mob, violent breaking through the doors to the area he was in. She just happened to be the first one stupid enough to try a climb over the barricade. Fortunately, no one else tried.

If Babbitt had been an unarmed Black woman who was shot at point blank range by a White police officer, would that have been a violation of her civil rights?

Well you all in the MAGA camp would be cheering. Pointing to a parking ticket as proof of her long criminal history.

nope, Floyd and Babbit both died as a result of lethal force. UNNECESARY lethal force.

4th Amendment Rights
The Civil Rights Act of 1871, which is codified as 42 U.S.C. Section 1983 and commonly known as “Section 1983,” prohibits any person from violating constitutional rights while acting “under the color of law.” In other words, it is unlawful for someone acting in an official governmental capacity to deprive another person of their constitutional rights.
Excessive force is a type of police misconduct where the officer’s actions go beyond the bounds of force that a reasonable officer would use under the same circumstances. These cases focus on the objective reasonableness of the force used – not whether the arrestee was injured. Whether the officer’s use of force was excessive depends largely on the circumstances and facts of each specific case. A judge or jury will weigh the available evidence and applicable laws to determine whether or not the police officer applied a reasonable amount of force.
So we have the right to disobey an officer of the law who is pointing a gun at you and telling you to stop? There are a lot of dead people who tried that. She also was part of a mob trying to hang the Vice President.
