Judge Hands Gavin Newsom Control of National Guard in Blow to Trump

Black’s Law is a much better reference for legal definitions.

Rebellion

Definition and Citations:

“Deliberate, organized resistance, by force and arms, to the laws or operations of the government …”
I did a republic for government is the people and what the people vote for Donald Trump because they want him to remove illegal aliens that commit criminal Acts a judge saying no you can't be Commander in Chief over the national guard is rebelling.

Then there’s federal law, which should be familiar to all that witnessed the historic attack on Congress by deranged, violent Traitor Trump cultists.

§2383. Rebellion or insurrection

Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.

IF January 6th, 2021 wasn’t a “rebellion”, no way the protests in CA are.

😄 Horse shit.

🤣 More idiotic horse shit!

🤣 Even more horse shit!

Judge Breyer’s order was not overturned.

The Traitor Trump administration was granted an “administrative stay”.

“In an order following an afternoon hearing, Breyer concluded that "Defendants are temporarily ENJOINED from deploying members of the California National Guard in Los Angeles. Defendants are DIRECTED to return control of the California National Guard to Governor Newsom."

In the case, Trump is the defendant and Newsom is the plaintiff.”

Newsom wrote on X on Thursday:"BREAKING: The court just confirmed what we all know — the military belongs on the battlefield, not on our city streets. This win is not just for California, but the nation. It's a check on a man whose authoritarian tendencies are increasing by the day. End the illegal militarization of Los Angeles now, @realDonaldTrump. History is watching."

🤣
Newsom is desperate to maintain his leadership of the opposition against Trump. He is actively campaigning to stay in the news so he can launch his presidential campaign next year.

They don't seem to understand that the national guard is national in the answer to the Commander in Chief for those courts seeking deploy it that's his job.
"The National Guard is a state-based military force"

The president is only allowed to deploy the guard in certain, very limited, curcumstances.

Generally speaking it is the gonernors job, not the presidents, to deploy the guard.

If Governor dick cheese I had not been fingering his starfish while la descended into chaos he would be humiliated by his lack of action.
The president is only allowed to deploy the guard in certain, very limited, curcumstances.
Like seditious piece of shit governor in seditious piece of shit mayor letting terrorists destroy the city.
Generally speaking it is the gonernors job,
World Governor horseshit for brains didn't do that
not the presidents, to deploy the guard.
And in the case of an incompetent corrupt piece of shit worthless scumbag governor saying "**** you L A I hope you all burned to death" the president needs to act.

If governor's scumbag didn't want to be humiliated he should have been such a corrupt bag of asses. I think you should face charges of sedition

Governor dick cheese I

seditious piece of shit governor in seditious piece of shit mayor

World Governor horseshit for brains

incompetent corrupt piece of shit worthless scumbag governor

governor's scumbag
Wow. Childish name calling and no evidence to back up your point.

If you think you can have an adult conversation someday get back to me.

The District court judge granted the plaintiffs request to second guess the President’s decision to deploy the National Guard in the face of uncontrolled anarchy. The judge claimed there was no evidence to support the President’s decision despite the violence, looting, and organized illegal actions.

The law gives the President the authority to issue a finding of rebellion as just cause for deploying the National Guard. You don't understand that, do you? The judge decided to ignore the mountain of evidence supporting the President’s legal finding in favor of parroting the Democrats "mostly peaceful" propaganda.

Let's observe that your analogy is completely irrelevant to the issue at hand.

Indeed, the referee/umpire/legal expert isn't empowered to insert his or her personal opinion of the Bad Orange Man as a substitute for the law.

Wildly irrelevant. A violation of discovery rules has nothing to do with a District court judge second guessing a Presidential declaration.

The case was brought out of purely political ambition on the part of Gavin Newsome.

Except that is not what happened here. There was no lofty legal analysis involved. The judge ignored the evidence to side with the Orange Man Bad lynch mob.

That was a Rebellion? Tell me why the Bundy Ranch wasn’t a Rebellion by these standards?

There is no evidence of "uncontrolled anarchy"

But there must be evidence of "rebellion"

The president cant just make shit up as an excuse to deploy the guard.

In this case there is no evodence of rebellion.

No the judge found there is no ebodence to support the presidents position.
The 9th court of appeals, one of the most reliably far Left in the country, quickly stayed the judge's ridiculous denial of reality. But restoring order played no part filing the lawsuit. It's all about abusing the court system for political power.

There is so much wrong up there it's challenging to decide where to begin.

Los Angeles is the second most populous city in the US and covers over 500 square miles. Some violent protests took place within a 5 square block section of downtown Los Angeles. Destroy the city? Humongous hyperbole. It would take a nuclear weapon to destroy LA. LAPD has 8,800+ officers. LACSO has 10,000+ officers. CHP has 6,000+ officers. No military was ever needed in LA. That was just Trump distracting Americans at a time when he is pushing to get a tax bill passed that will remove Medicaid health insurance from 9 million Americans and add $5 trillion to the US debt/deficit.

Trump's LA military escapade cost American taxpayers $150 million and his military parade on Saturday cost American taxpayers another $45 million. In just a two-week stretch, Trump wasted ~$200 million of taxpayer money.

Yep, this is the same Trump that complains about waste in government. But HIS government waste is somehow different. Then there is the matter of retrofitting the jetliner from Qatar. More millions wasted.

Well I figured they were going to do nothing like they did in previous riots until their hand was forced

And there's no possible way that the mayor who should be intimately familiar with the city didn't know this unless she's just the most incompetent boob that ever boobed.

I didn't say completely annihilate.

Well it's needed to be there in case the politicians are true to form and act like stupid idiots. They rushed out there police so as not to be made fools of. That was the idea.

Good think he's saving so much by not increasing spending on Medicaid.
Yep, this is the same Trump that complains about waste in government. But HIS government waste is somehow different.
I don't think it was waste for the celebrate the army's 250th anniversary and to make sure Newscum and the LA mayor do their damn job.

Apparently you're unaware of police radios and text messaging.

I didn't say completely annihilate.

You said "Destroy the city". Exaggeration on steroids.

The number of police availlable for 5 square blocks is 24,800. Inexplicably, you and Trump think the military is necessary to "save the city". Such unadulterated crappola.

Good think he's saving so much by not increasing spending on Medicaid.

I pray no one in your family gets booted from Medicaid just so Donnie can give billionaires another tax break.

Donnie needed a parade for his 78th birthday. Der Leader be 82 in 2028, the oldest president when he gets the Constitutional boot.

Trump is appealing. If heard, it will go to the 9th Circuit, which leans liberal. If Trump loses, he’ll go to the Supremes.
Trump's long and distinguished record of failed appeals and spurious lawsuits should have taught him something. But no; he's like the lunatic repeating the same mistake, hoping for a different result.

Ask the merchants in the LA chop zone if their businesses haven't been destroyed by the violence and arson of the mostly peaceful protesters. Ignore the effort it took to prevent the thugs from blockading the freeway running through the center of the city. The Democrat endorsed violent thugs are just innocent folks having fun watching cars burn. Nonsense.

Right, strip every police officer from the surrounding area to serve as targets for the Leftist thugs throwing rocks, chunks of cement and cinder blocks, setting off fireworks and molotov cocktails. Never mind the consequences of leaving the rest of the city unprotected, just whine about deploying the National Guard to save lives.
I pray no one in your family gets booted from Medicaid just so Donnie can give billionaires another tax break.
Nobody is getting booted from Medicaid to give billionaires a tax break. Such unadulterated crappola.

There is purpose with that though, and part of it is to tie things up in court for long periods of time with the hope his opponents run out of money and quit. The difference now is he no longer has to do this out of his own pocket, since he's converted the DOJ into his personal law firm along with the ones who capitulated when he threatened them.

You dont know what a stay is do you.
You only know how to sling accusations don't you.

In granting the stay the Court took into account the likelihood of the plaintiffs case success. They wouldn't have granted the stay if they assessed the case as likely to succeed. But hey, only judges who pander to the Orange Man Bad lynch mob are credible.

Democrats are on a pace to file more than a thousand lawsuits during President Trump’s second term in a blatant campaign to promote judicial tyranny. But let's ignore the fact the Democrats are ignoring the will of the voters in the election by filing more lawsuits to harass the Bad Orange Man than every other President faced combined. It's Trump's DOJ defending against the campaign of using lawsuits as a means of political repression that's the problem.

I can see how one who thinks the president can just exert their will regardless of the law, would think that. I do like the "judicial tyranny" term, is this the next level of LAWFARE™?

I guess in some weird world where the "will of the voters" is supposed to supersede the law, your comment makes sense. That anyone supporting Trump would be complaining about filing lawsuits is a bit rich considering that's been his go-to strategy for decades.

. They wouldn't have granted the stay if they assessed the case as likely to succeed.
No, that isnt why.

"The primary purpose of a stay is to preserve the status quo between the parties. This keeps the issue of contention ripe for the courts so they can adjudicate it. In other words, the stay helps ensure that any decision rendered by the appellate court will actually make a difference.

Another basis for a stay is demonstrating irreparable harm in its absence. The appellant must show he or she will lose the benefits of appeal if a stay isn’t first ordered. Take, for instance, a land use issue that invokes claims of environmental damage. The plaintiff sues to stop the development of the land by arguing it will hurt the environment. If the plaintiff loses at trial, the defendant will presumably develop the land immediately. Without a stay, the plaintiff might argue, the environment would be irreparably harmed negating the benefit of an appellate win."

Why should you even try to summon up an argument when you can just offer up a straw man. Attributing the Democrat nonsensical talking point that opposition to the anti Constitutional perversion of the judiciary into a super legislature is support for a lawless President is just incendiary claptrap. Congress has the power to restrain or even remove the President by design.

Of course Democrats not only lost in the 2024 elections their policies aren't supportable in the public forum so they are reduced to naysayers screaming Constitution.

The weird world is one where Democrats pervert the role of the judiciary into a gang of some 650 Lilliputians each with the power to dictate their whim on to the President at the behest of Democrat hired lawyers.

Still no intelligent answer as to why besides a partisan political power grab Democrats should be allowed to usurp the election.

What is unique about this situation is the unprecedented attempt by Democrats to use the District courts as a universal veto over every action of the Trump administration. Yes, courts have the authority to check the President’s abuses but Democrats have launched an unprecedented volume of lawsuits demonstrating their intent to rule by suing.

It's no surprise the same political party that cheered as FDR shattered the 2 Presidential term convention is all about using the judiciary to marginalize the Presidency with no regard to the impact on future Presidents.
