Judge Hands Gavin Newsom Control of National Guard in Blow to Trump

Did I complain about the judges? No.

What I complained about - if that's what you want to call it I'd call it - was the characterization that the panel was "radical left" which given the 2 Trump appointees on the panel is false as is the implication that because it was a "radical left" panel that the case wasn't even a close call.

I was also at pains to say that I wasn't implying that the Trump appointees ruled as they did because they were Trump appointees.
My comment referred to the history of the 9th circuit court of appeals. A history that makes this decision surprising.

You may not go along with the talking point Trump's actions are so blatantly unconstitutional even Republican judges reject them but it's parroted frequently.

This Trump is losing in court talking point is frequently parroted. But as this case shows counting injunctions from District courts as victories is problematic.

An attractive feature to the Orange Man Bad lynch mob of the strategy of filing hundreds of lawsuits is that it muddies the waters to the point it's difficult to get a clear picture of the campaign's success or failure.

If you'd bothered to look at the lawsuits instead of parroting simplistic talking points you'd find they are the product of a deliberate design to drag every policy of the Trump administration before a Federal District judge bypassing Congress. Nothing is more blatantly unconstitutional.

Again vague generalizations. Control of the California National Guard was returned to the President on appeal. SCOTUS dismissed the DC deportation lawsuit for lack of standing. Yesterday the SCOTUS cleared the way for the Trump administration to resume deportations to third countries.


Pretending the decrees of forum shopped District court petty dictators are "curb stompings" while they get reversed on appeal isn't fooling anyone.
