They were not criminal defendants.
They held under the laws of war, not in the legal system, and thus did not have a right to counsel.
It is entirely correct and proper to question Judge Jackson about this.

Does your post above in the quote box have a point relative to her nomination to the SC? Ketanji Jackson in that quote is asking a very specific question about pedophilia as a crime and whether in all cases obtaining child pornography fits as a crime of pedophilia. For example, dealing in media that includes child pornography is also a crime. Does that in all cases or in fact even in many cases mean the purveyor of such media is also a pedophiliac? The same applies to drug dealers who very very often do not themselves indulge in the drugs they sell. Does not make being a purveyor of such media is any less a crime.
