The 'gangs' IS Haitians. And Haitians IS the gangs. Without outside rule (i.e French) they become equivalent.

They don't.
That's quite often the case with refugees. So some admissions are decided with incomplete information and a judgement that yes this person would be in danger in Haiti based on interviews.
