Rowan County, Kentucky clerk Kim Davis, who notoriously refused to issue same-sex marriage licenses after the Supreme Court ruling on the issue, could now go back to jail.An attorney for one of Davis' deputy clerks alleges that Davis dropped her name and the name of the county from the county's licenses — thus making them invalid, the Associated Press reports.


That's a direct violation of a federal judge's order to not interfere in any way with the licenses.

She is also forcing her deputy to sign marriage licenses as a notary of the public instead of as a deputy clerk.

Exactly how does all this play into "religous liberty"?

She needs to quit her job if she refuses to do what she was hired to do. Period. Now she just wants to be a martyr.

Yes she does. She also has the obligation to do what she was hired to do. And the legal obligation to do what the courts ordered.

She can resign if she can no longer do her job. She can go back to jail if she fails to do what the courts ordered.

I like how the goal posts keep moving. At first it violated her religous liberty to have to issue the forms herself. Next, it became a violation of her religous liberty if her deputies issued the licenses. Then it became a violation of her religious liberty if the license mentioned the county. I think it is clear that her supporters would support her no matter what she does or how she abuses her office because this has nothing to do with "religious liberty" and everything to do with opposing the right of same-sex couples to marry.

She'll go back to jail. That's why the judge put her there in the first place, to make an example out of her. Obviously, 6 days wasn't enough.

She was elected to do her legal job. That encompasses signing any document the government wants her to sign. Gay marriages are allowed now. She should do her job. Period.

Her job was never to sign approval of gay marriage.

She should get an accommodation to not have to sign approval.

Her release order specified a status report from her & her clerks two weeks from her release date.

I think she just forced the Judge's hands, to be honest.

I'd give her 30 days minimum, maybe 60.

No one gets to thumb their nose at the judicial system.

I feel bad that she denied your gay marriage license. Wait...you DID get your license...it just had a notary, not the clerks office on it...right? So....you and your boyfriend could still get married and legally...right?

7,353 people in her county elected her to follow Kentucky law. With the exception of Winston who has said she is vilolating his rights, I highly doubt any of the rest of you live in Kentucky...let alone Rowan county. Its entirely possible and more than probable that her constituents WANT her doing exactly what she is doing because they are probably part of the 75% of Kentucky that voted not only to pass a law against gay marriage in Kentucky but to also put it in their Constitution.

I get it...I get it. The Supreme Court has ruled and now people like yourself and all the other blog posters from around the country are insistent she 'do her job' and 'do what she was elected to do'. From their perspective...she is.

As per the OP...is she banning anyone from getting a marriage license?

I honestly don't know. You can't just tell me?

She was told she doesn't have to have ANYTHING to do with the process, and her deputies volunteered to do her job for her. She didn't need to raise a finger. Instead she's decided to be an activist and actively prevent her deputies from issuing the license. THAT is the problem.

"Davis' attorney said this new form, if OK with the judge, would solve the problem because gay couples would have a marriage license and Davis would have a clear conscience. Kentucky's Democratic governor and attorney general have both said the licenses are valid and will be recognized by the state."

So....how is she denying anyone a license again?

She was not elected to sign gay marriage certificates.

There is no such thing as a "gay marriage certificate". It is a piece of paper. Her job is to issue it, which includes a signature indicating that it was properly issued. It is not optional, state law requires it.
