What's your point? Jailing people for crimes is the result of due process, the standard necessary for removing people's liberties as set by the 6th amendment. Being jailed isnt an infringement of your right to liberty, as you lose your right to liberty once you are convicted of a crime.

Like you just said, it’s a just infringement. The right to liberty is not absolute; it is not a sovereign power of the individual.

This isn't an 'allowance for infringement', its a discussion of the defintion of the right to arms, specifically, what arms are covered by the 2nd. Within that definition -- that is, as long as the weapons in question qualify as 'arms' -- the right cannot be infringed.

WMDs do not qualify as 'arms', and so there is no Constitutional issue with laws that forbiut their posession, require their rgistration, etc

I don't have the case law handy but I do know that felons are denied their 2nd amendment rights on the grounds that they are a significant danger to the public; though policies in this regard can very. The compelling state interest here would be in protecting the populace.

and nothing protects a populace better than to have law abiding citizens heavily armed so they can defend themselves, or resist the government if it turns on the people.

I should probably note that at this time i do not own any weapons. but my brother has multiples, and so does my best friend. And another friends father has his own shooting range in his backyard and a small arsenal of various weapons.

I should probably note that at this time i do not own any weapons. but my brother has multiples, and so does my best friend. And another friends father has his own shooting range in his backyard and a small arsenal of various weapons.

I tend to get heat from both side at one point or another, because on the one hand I claim that the second does not, for example, protect you from mounting a 50 cal. on your private aircraft, and that the government has an interest in mandating a competency test with the weapon class before the citizen can buy; while on the other hand I claim that the 2nd does cover grenades, machine guns, APCs, etc.

I oppose registration, btw. I make a distinction between having to obtain proof of basic competency to buy and having to report what you actually own.

I entirely agree with this point. Registration is almost as not being able to own weapons, but being required to prove competency with a weapon should be required. Nice post Jerry, I like to see the South Dakota common sense showing through.
 
My state Got a C-

My state is quietly getting ready fight against Bush's and Cheney's attempt to over throw the federal, state governments and destroy the Constitution. We are qetting ready to fight Bush's right wing gestapo/corporate/goon/mafia hit squads when they appear in our streets.

I love my guns, my constitution, and my country, and I am ready to die to preserve our laws and constitution, no matter what Bush and Cheney want.
