There is no statute that covers "having documents" so you are right he won't he charged with "having them" .

No they pushed it because he refused to return them and they could not allow these documents to be retained by a private citizen in a country club.

Yes there was. His refusal to return them all demonstrates intent in keeping them which is a crime.
.....and if it's true he shared them with others he is in serious trouble as it appears from the affidavit the documents, at least some of them, relate to national defense.
He also ignored a lawfully issued subpoena and lied to the FBI-those are also crimes.
What else could he do? he had no right to have them and he never divulged that he did.
