Must be 18 to qualify for surgery, Must have lived as the opposite sex for at least two years and the Psychologist must make the judgment that this person absolutely is of the opposite gender and hasn't even the slightest urge to go back.

i think the issue is legitimate to discuss, but as none of us know him/her personally, we have no idea what the mental state is.

I think the bigger issue here is that gender isn't all that cut and dried. It is in 99.9% of all cases, but here we have that one oddball that doesn't fit. Gender is determined a lot of different ways. Remember that sprinter from South Africa who was in the news a while back? If I recall correctly, the track and field governing body determined his/her gender by the amount of testosterone and/or estrogen in her bloodstream. Which sexual organs that person possessed was immaterial.normally has the right parts but ALWAYS has the Y chromosome.
So if she still looked female, but through some futuristic genetic surgery, obtained a Y chromosone to replace the X, you'd call her male?
Look up Gender: the behavioral, cultural, or psychological traits typically associated with one sex.
Notice it is not neccessarily the sex itself.
Today there are legal and medical standards, and regardless of how anyone "feels" about it, the fact remainds this is where we are. There is a recognized condition with recognized standards of treatment, which include gender reassignment, legally changing from one gender to another.
