Toledo judge refuses to perform gay marriage [W:148:467]

Re: Toledo judge refuses to perform gay marriage [W:148]

He didn't break the law actually. He didn't violate the rights of others. He didn't lie. He didn't cause anyone "damage". So much for your argument.

He used his position as government employee to refuse exercise of right to contract when that is specifically part of his job.

People either do their jobs or they don't. Those who don't get fired.

Re: Toledo judge refuses to perform gay marriage [W:148]

You know what is worse? A judge disobeying the law that he was sworn to uphold. Do you really want judges out making their own interpretations of settled law?

Do you?

Is SSM legal?

Is interracial marriage legal?

Sure, Freisler was just doing his job. Right?

Of course, SSM is not quite comparable with the Scholl kids and all. But it is quite important, as the First is central to the Constitution and the Constitution is, what differentiates us from dictatorships and protects us from going down that path. That is why your opinion is so horrendous and that you don't even seem to understand these things is outright scary.

And no, the USSC does not decide according to law it is supposed to decide, if Congress kept within the limmits set it and judges are supposed to ask a higher court, when the Constitution is at stake.

Re: Toledo judge refuses to perform gay marriage [W:148]

The judge took an oath to obey the law. The law is that the right to bear arms is legal, if he refuses to allow people to bear arms in his courtroom, he is not obeying the law he took an oath to uphold.

That is how horrible your argument is.

The law is that firearms are not allowed in the courtroom, please, by all means, take that to the supreme court. LOL That is all you got? Guns can be restricted in lots of areas, you do know that don't you?

So, I ask you, what do you do with a judge that refuses to marry an interracial couple, or a couple of athiests or of a different religion. What is your answer.

I think that we have put ourselves into a situation that is untenable. But since the Congress is not allowed to pass a law that infringes on a citizen's religious practice, it would seem obvious that he can take a conscientious objection.

Re: Toledo judge refuses to perform gay marriage [W:148]

Last thing we need is more public employees doing **** to get their municipality sued. They won't have to bear the financial consequences the taxpayers will.

Good, crash the system.

Re: Toledo judge refuses to perform gay marriage [W:148]

Have you ever taken an oath?

A judge takes an oath to uphold the law. SSM is law.

Well, he is upholding the Constitution, which is the law of the land. You know, the part about religious freedom and all that.

SSM is legal, it is the law of the land. He has to uphold the law, and specifically, same sex marriage.

Interracial marriage is the law of the land too, what would you do if he refused to marry interracial couples? Or couples from a religion he doesn't approve of?

No one seems to want to touch that one, do they?

All the way to a new job. Congress would not infringe upon the man's religious practice, but government cannot be allowed to hold its personal religious opinion over the free exercise of rights by the citizens. That's what happened here.

If you can't do the job you were hired to do, you get fired. It's pretty much that simple.

Nope. That is not logical and you must know that. It is so parallel to the issue in conscientious objection to military duty that even an untrained mind can hardly miss it.

I'll touch it, and smash it. On what religious grounds would he refuse an interracial marriage? I'll answer that for you - none. So that doesn't apply. Come up with a better strawman, I'll smash that too.

:lamo
complete failure

1.) who said YOU get to determine others religious grounds?
2.) also I gotta ask the question, what does his religion have to do with LEGAL marriages . . he shouldnt be doing ANY then minimum he should have also refused every other one that didnt match his subjective opinion of marriage.
sooo you smashed nothign, more like swing and a miss LMAO

I started ignoring his inane posts yesterday. I got tired of the "If a dog was in the back of a truck and the truck was pointed east and a plane passed overheard and a sheep wandered by was the sheep gay?" kind of questions.

thats because it exposes the dishonesty, hypocrisy and or bigotry behind the claim that some how this is magically different. Nobody honest and educated on the topic buys that lie

Yep, there's a person or two here that will argue with you that 2+2 does not equal 4, no matter how much evidence there is to the contrary, as long as Obama or some liberal said so, it's true. I don't waste time replying to those idiots, they are incapable of logical reasoning.

That's military, and if someone in the military refused to carry out an order because of their religious beliefs, they would not be in that position for much longer. They would shuffle them somewhere else. This judge can do the same. But there's a far difference between a soldier refusing an order based on morality and a judge using his power as government official to interfere with the free exercise of contract of a citizen.

If he can't do the job, he can find a new job. Only the most entitled of the entitled would disagree with that.

Doesn't matter, what if he does? Interracial marriage is law, just like SSM is the law.

Can't disobey the law, he needs to either marry them, or get a new job.

SSM is the law, the Judge's job is to obey the law, end of story. You have NOTHING.

And to prove that you have no argument, you bring Obama into it and "liberal"

SSM is the law, as are interracial couples or couples of mixed religions.

Now, I know that some religious folk find that someone getting divorced and re-marrying to be offensive....but, they have every right to marriage as well, what if a judge refused to marry someone that was previously married?

Are you only for the rule of law when you agree with it?

Why do you assume it's "specifically part of his job?"

Re: Toledo judge refuses to perform gay marriage [W:148]

Because judges rule on the law.
All judges rule on the law. Some are authorized to perform marriages. Few, if any, are required to do so as part of their job. So again, what makes it "specifically part of his job?"

Re: Toledo judge refuses to perform gay marriage [W:148]

Since when does the left give a sh*t about the Constitution???

Why do you insist on placing people into political boxes? As if someone can't have multiple different leans, depending on what is being talked about?

Please explain exactly why what the judge in the OP did is different than what this JoP did.
