A President Donald Trump might push for Americans accused of terrorism to be tried in military tribunal at the U.S. Navy base in Guantánamo Bay, Cuba, the Republican nominee told the Miami Herald on Thursday.
“I would say they could be tried there, that would be fine,” Trump said in a brief interview ahead of his speech to home builders in Miami Beach.
Under current federal law, it’s illegal to try U.S. citizens at military commissions.

Just when you thought the level of ignorance has reached its apex, the Donald comes out with an even more ridiculous comment than the one which left you shaking you head only minutes before.

Well it's apparently legal to kill them with a drone when they aren't an immediate threat...

American citizens in the US?
It's also not an act of war to kill people in other countries if there is no boots on the ground - Obama logic.
Yes, Obama actually said without even realizing it that Japan did not commit an act of war by bombing pearl harbor.
American citizens not in the US for sure, unknown about whether it would be legal in the US. But there is clearly a precedent for treating terrorist "citizens" like combatants. Trump has said a lot of dumb things but this isn't one of them.
You can kill an American who is fighting with the enemy, either here or abroad. I have no problem with that. We legally kill Americans who attack cops and/or citizens all the time. You can't try an American civilian in military court though. Even a 5th grader knows that.
We don't kill them while they are at a cafe eating dinner
This isn't even suprising. It's Donald ****ing Trump.
Every five minutes he says something stupid or outrageous.
Almost as often as Clinton gets a contribution to her foundation from people that hate America.
They killed Dillinger when he left a movie theater, and blasted Bonnie and Clyde straight to hell while they drove down a country lane.
So you think that behavior is still acceptable for law enforcement?

That's citizens fighting against US soldiers outside of the US. Actually, that's not at all what Trump was referring to. He specifically said "terrorism," which clearly implies domestic terrorism. Terror committed by rogue Americans in other countries would be handled by law enforcement or the military in those countries.
Yeah, they did........ It's pretty ****ing obvious that they did commit an act of war, as a matter of fact.

Of all the things Trump has said, this seems to be fairly insignificant. NOt sure what evidence you have that 5th graders know this or why it is you think a businessman with no legal education would know it. Seems to me that you are just piling on at this point with a non issue. But so long as you brought it up, which Obama is dumber than a 5th grader--the Obama that said he could not legally change immigration law or the Obama who said he could?
where was that defined?
Enemy combatant can be domestic as far as I understand the term.
....a U.S. Supreme Court case that ruled the application of military tribunals to citizens when civilian courts are still operating is unconstitutional. In this particular case the Court was unwilling to give President Abraham Lincoln's administration the power of military commission jurisdiction, part of the administration's controversial plan to deal with Union dissenters during the American Civil War.
The one who said there were 57 states.
BTW: What you call "insignificant" is, and this is quite clear, absolute proof that Trump is extremely ignorant on matters pertaining to US law, probably the most ignorant man ever to run for the US presidency on a major ticket.Of all the things Trump has said, this seems to be fairly insignificant. Not according to the logic Obama put out there. To him unless you have boots on the ground there is no act of war, which means, you can bomb the **** out of people, hell, nuke their asses, and according to the logic Obama crapped out of his face no act of war occurred.
The closest we have to defining an American citizen who is an enemy combatant on US soil is treason, rebelling or giving aid to the enemy. Treason et al by civilians is tried in criminal court.

We also have some exceptions to the ban on civilian's being tried in military court, like during times of Martial Law. But, even there, the hurdles are high.
