A President Donald Trump might push for Americans accused of terrorism to be tried in military tribunal at the U.S. Navy base in Guantánamo Bay, Cuba, the Republican nominee told the Miami Herald on Thursday.

“I would say they could be tried there, that would be fine,” Trump said in a brief interview ahead of his speech to home builders in Miami Beach.

Under current federal law, it’s illegal to try U.S. citizens at military commissions.

Without a transcript of the entire interview, an edited 1:07 video is worthless. At this point, the Miami Herald has not made such a transcript available. So, nothing can be determined, other than another in a long list of dog whistles has been sounded.

American citizens not in the US for sure, unknown about whether it would be legal in the US. But there is clearly a precedent for treating terrorist "citizens" like combatants. Trump has said a lot of dumb things but this isn't one of them.

You can kill an American who is fighting with the enemy, either here or abroad. I have no problem with that. We legally kill Americans who attack cops and/or citizens all the time. You can't try an American civilian in military court though. Even a 5th grader knows that.

For enemies of the state who pose a direct threat to its people? Yes.

We don't do it often, but doing so is sometimes quite justified. Remember the cop killer in Dallas, the one we killed with the robot bomb? Justified.
 

That's citizens fighting against US soldiers outside of the US. Actually, that's not at all what Trump was referring to. He specifically said "terrorism," which clearly implies domestic terrorism. Terror committed by rogue Americans in other countries would be handled by law enforcement or the military in those countries.

NOt sure what evidence you have that 5th graders know this or why it is you think a businessman with no legal education would know it. Seems to me that you are just piling on at this point with a non issue. But so long as you brought it up, which Obama is dumber than a 5th grader--the Obama that said he could not legally change immigration law or the Obama who said he could?

The closest we have to defining an American citizen who is an enemy combatant on US soil is treason, rebelling or giving aid to the enemy. Treason et al by civilians is tried in criminal court.

In this particular case the Court was unwilling to give President Abraham Lincoln's administration the power of military commission jurisdiction, part of the administration's controversial plan to deal with Union dissenters during the American Civil War.

We also have some exceptions to the ban on civilian's being tried in military court, like during times of Martial Law. But, even there, the hurdles are high.

BTW: What you call "insignificant" is, and this is quite clear, absolute proof that Trump is extremely ignorant on matters pertaining to US law, probably the most ignorant man ever to run for the US presidency on a major ticket.

And, it appears the general voting public is well aware of that fact.

The United States didn't invite Japan to conduct bombing raids against insurgents in their territory who are seeking to overthrow the US government last time I checked.

Well Justice Calamity, the Conveniently Literal Left certainly turns itself into pretzels to push these desperate narratives. I find it interesting that after two days, the Miami Herald still has not provided transcripts of the interview they had with Trump.

Rather than depend on implication in the dog whistle headline of your thread, or on the MH's banner created from a prayer they will get some attention, people properly inoculated against the viral disease known as the media can get to the truth.

After watching the video, and reading the carefully edited commentary attached, one can see the following:

Trump defined who he was talking about:

“I want to make sure that if we have radical Islamic terrorists, we have a very safe place to keep them,” he said. President Barack Obama, he added, is “allowing people to get out that are terrible people.”

So your Honor, could you explain how Trump is dumber than a 5th grader, when in the end you admitted it is possible to try a civilian US Citizen in a Military Court? Could you also explain why you ignored the other circumstances a US Citizen could be tried in Military Court, outside of Martial Law, that were detailed in the PDF you linked to?

Could you point, your Honor, to any qualifier Trump made in his answer to the reporter in regards to what these US Citizens were doing when caught, or who they were working for?

Could you identify words in Trump's answer that indicate he specifically would approve of any average US Citizen aiding and abetting Islamic Terrorists to be tried in Military Court in Guantanamo?
