Slavery was banned across the North and the Founders did nothing to stop it, which they would have if slavery was protected.

They didn’t let states ban freedom of speech or freedom of religion, after all.

Our laws also reflected English Common Law.

And the philosophy of John Locke to rely on consent of the governed.

And to Baron of Montesquieu for divided government.

And Edward Coke in regards to civil liberties.

The North weaned off of slavery in the 1800s. The South remained stuck in their old ways. They needed a civil war to be liberated from slavery.
