I'm not crying about it. It's a matter of record that he used lethal force against without warning and he then created a false cover story over the radio to justify his murder. He should be charged for that. Whether or not he will be is another story.

I honestly don't see your argument but I am open to listening to it. I just don't see it from what I know about the event. I do believe there is more than enough to conclude his actions are sufficient to meet the criteria for murder.

Do you not know that he shot her without any verbal warning and no imminent threat being present? Do you dispute that after he gunned her down that he transmitted over the radio that he heard gunshots were fired from an unknown source? Do you dispute that the only gun shots that took place at the time in that location were his? Please enlighten me on which part you think is Bull Shit.

You can disagree with me that his actions were murder but at the very least reasonably people should agree that a trial is warranted to determine if it was or was not. Let a jury determine if his actions were criminal.

They are saying that shooting an unarmed 120lb woman was not excessive force.
He could have just pushed her back.

He was the guy in the Giants sweatshirt who was there and tried to catch Ashli Babbitt the split second after she was shot. He was interviewed outside of the Capitol by local Washington D.C. television station WUSA-9. When asked about the blood on his hand, he stated, “We had stormed into the chambers inside and there was a young lady who rushed through the windows. A number of police and Secret Service were saying, ‘Get down, get out of the way.’ She didn’t heed the call and as we kind of raced up to try to grab people and pull them back, they shot her in the neck, and she fell back on me.”

There was an imminent threat. An angry, violent mob was threatening police, trying to break in and had already smashed out 3 of the 4 windows to get in. Byrd waited until the first one entered before firing.

And there are conflicting reports as to whether or not she was warned.

As far as a trial, if he were to be found not guilty, there would still be those upset. Only now they would complain it was an unfair jury.

My favorite part of the story is how MAGA favorite Congressman Markwayne Mullin witnessed the shooting (he was one of the Congressmen Byrd was protecting), and has repeatedly stated that Byrd saved lives, and had no choice but to shoot.
