It was unpaid leave requested - kids get 2 weeks off of school for Christmas. . . and other teachers are permitted off for other holidays.
If the issue is about something else they should have directed it to that.
correction, kids get 2 weeks off for winter break. and other teachers are permitted off for other federal holidays (as is she)
the only way I can see her having a case is if the school board allows other teachers to take 3 weeks unpaid leave for personal, non-medical reasons.
when I taught, we accrued 9 personal days per school year. there was no limit to the number of days you could store. why the hell didn't she just save up her vacation days for a couple of years and then take paid vacation for 3 weeks? there would've been nothing they could've done to stop her. they can't deny you vacation you have earned.
there are too many options that were available to her. she is either stupid or she was looking to make a statement.
I think a more comparable situation would be that Catholics be allowed 40 days off for Lent. Would that be acceptable?

I think they should have allowed her to go on unpaid leave to go on a religious pilgrimage. I don't think her request was unreasonable and she has a right to sue.
not many employers will allow you to take unpaid leave for personal reasons (religious or not). she should've saved up her vacation and taken 3 weeks paid leave. that way if they had denied her request to use her earned days of vacation she definitely would have a case.
I don't know the numbers for the average workplace, but I've granted quite a lot of leave - paid or otherwise - for employees who were failthful to the company and who had personal issues come up.
The notion that "no one ever gets it" is ridiculous. I granted it for everything from finals-week for college students to legal issues for others.
the point is, if it is the school board's policy to not grant it and they have not granted it to others...she has no case for discrimination.

why is the date such a big deal? they have changed other parts of the ritual for the sake of convenience.
Very very few are allowed back into the country once they perform their obligatory tour. There are too many Muslims who wish to go for Saudi Government to allow a selfish minority to keep coming back

having accumulated leave does NOT give the employee to take it at the time of their choosing. that is why a request for leave must be tendered ... and approved
whether she had accumulated leave in lieu of requesting leave without pay plays no point in this matter
wrong. how many years did you teach in public school? zero?
the request is a formality. leave is like part of your pay, they cannot tell you when/how to spend your pay, they cannot tell you when/how to spend your leave.
she would have a much stronger case if she had tried to use her leave and been denied rather than asking for unpaid leave.
both my parents taught for 30 years and my father was a HS principal for 15. I taught for 11 years and my brother has taught for 23.
