Maryland Officials Ready With Subpoenas in Trump Hotel Case

Only if said business violated Maryland law. Violating The Constitution doesn't fall within Maryland's jurisdiction.

Hell! Violating The Constitution isn't even a crime.

In order for a president to violate the constitution, there would have to be a DIRECT violation of the separation of powers, or something like defy a direct court order from the Supreme Court, or attempt to defy congress’ power of the pocketbook or other power reserved to the congress.

The emoluments clause, also called the foreign emoluments clause, is a provision of the U.S. Constitution (Article I, Section 9, Paragraph 8) that generally prohibits federal officeholders from receiving any gift, payment, or other thing of value from a foreign state or its rulers, officers, or representatives. Basically, it's an anti-corruption clause and has never been challenged in court in over 200 years.

Even if trump is profiting from it, you need more than that to prove the charge. You have to prove trump is directing people to stay at his hotel in exchange for something.

On the bright side it will keep the anti-trumpers occupied and out of trouble.

Good question but what popped out at me in less than a week the state of Maryland has been in the news over some strange stuff. A few days ago it was a Maryland judge that allowed an FBI raid on a former FBI whistleblower by the name of Cain to have his home raided. He had turned over documents to IG Horowitz that showed wrongdoing of the Clinton Foundation. Horowitz then turned them over to Congress. Next thing this Cain dude has a slew of FBI agents combing through his home for six hours and he told them he was protected by the Whistleblower act. Grassley wrote letters to Wray and Horowitz wanting to know what the Hell is up.

As far as Trump, you can call him a lot of things but stupid isn't one. With the atmosphere out there trying to comb through everything including his used toilet paper to find something to nail him on, he wouldn't be so stupid to conjure up ways to benefit from his presidency while he is still in office. That comes later.

Well, we've seen the left weaponize the federal government against political enemies in the last administration, is it really a surprise that the left also weaponize a state government against political enemies?

Actually, the surprising part is that it took them this long to figure it out.

Should 800 subpoena's be issued it would be blatantly clear to anyone with two working brain cells that they are all politically motivated.

Let's see both federal and state judges recognize that for what it is, and dismiss then all one by one, upholding both the legal system, the rule of law, and judicial independence.
 
The subpoenas target 37 entities, including 13 Trump-linked entities and the federal agency that oversees the lease for Trump’s Washington hotel. Subpoenas were also being sent to the Department of Defense, General Services Administration, Department of Commerce, Department of Agriculture and the Treasury Department, which have spent taxpayer dollars at the hotel or have information on Trump’s finances relevant to the case.

Other Trump entities that officials plan to subpoena include those related to his Washington hotel and its management. Eighteen private entities including restaurants, venues and hotels that compete with the Trump hotel are also being subpoenaed in an effort to “illuminate the unfair nature of that competition,” said Maryland Attorney General Brian E. Frosh.

“We are confident that at the end of discovery we will be able to prove our case — that President Trump is violating the Constitution’s emoluments clauses, America’s first anti-corruption laws,” Frosh said in a statement.

While news organizations have reported how groups representing Saudi Arabia, Kuwait, Bahrain and the Philippines have hosted events at Trump’s D.C. hotel since he took office, the subpoenas offer the best chance to get a complete picture of which foreign and domestic governments are spending at the hotel, how much they are spending and where that money is going. They’re also trying to determine how Trump’s hotel is affecting the hospitality industry in the District of Columbia and Maryland.

The subpoenas seek to prove that hotel revenues are going to the president through his affiliated entities, including The Donald J. Trump Revocable Trust. Most of the records are being requested back to Jan. 1, 2015.

The Justice Department declined to comment. Neither the Trump Organization, Trump’s personal attorney on the case, William S. Consovoy, nor the White House responded to a request for comment Tuesday.

You don't know what you're talking about. Show me some article or something else that you're getting the information that D.C. doesn't have the authority to prosecute violations of the emoluments clause.

"is this what it comes down to" This is what we've been trying to get through your Trumpster brains for 2 years. He's not only accountable to the U.S. Government for crimes, he's accountable to the State of N.Y. for criminal charges as well. It's true he can't be indicted while president but once he's out of office he's going to be criminally charged on multiple counts.

You're conflating the two occurrences the case of the violation of the emoluments clause in Washington, D.C. and the other charges that the Southern District of NY will bring against Trump's businesses and foundation. They are two entirely different things.

The District of Columbia isn't the Federal government.

And yet, the Obamas are making hundreds of millions of dollars off of their presidency, and the left couldn't care less.
 
I know, it's hard for anyone to keep these things separated. The violation of the emoluments clause is a lawsuit brought by over 200 Democratic representatives and senators. A judge ruled that they can sue President Trump over claims he violated the emoluments clause of the Constitution regarding his businesses with foreign governments. This would be under D.C. jurisdiction.

The Southern District of NY will handle all the hard-core stuff like money laundering, tax fraud, campaign contribution fraud, Trump Foundation fraud, bribery, etc.

The point of the emoluments clause is to prevent the President from being paid by foreigners to influence him. That's never happened with any President. It has absolutely nothing to do with companies he has an interest in doing normal business.
So, this is just another waste of time by the left, there is zero chance of it succeeding.

I'm just absolutely stunned and the lengths Trumpers will go to trying to equate the violations of the emoluments clause by Trump with the gifts that presidents of the past have received. It's standard protocol for a foreign country to give a gift to a U.S. president. Gifts are legally ALLOWED and all gifts are registered with the State Department's Protocol Gift Unit.

Okay so let's do a comparison of apples to oranges, shall we? I'll begin with the gifts registered by President Obama with the State Department's Protocol Gift Unit. In addition to a 4 x 5 foot rug with his face on it given by Russia, Barack Obama received 14 blankets from various countries and U.S. Tribal Nations. Some other gifts listed numerically;

1. A five-inch Aztec calendar in silver, given by Mexico in 2012.
2. A Maori club, given by New Zealand in 2011.
3. A ping-pong table, given by the UK in 2012.
4. Four bottles of tequila and a silver ark in a trunk, from Mexico in 2009.
5. A stainless steel watch, a brooch, and a ceramic dog bowl from the Czech Republic in 2009.

Keeping in mind Trump's own words; "The president can't have a conflict of interest" I will give you some detail as to how he has done exactly that.

According to Forbes, Trump rakes in at least $175 million annually from commercial tenants like the state-owned Industrial & Commercial Bank of China. At least three dozen known Trump tenants have "meaningful relationships with the federal government, from contractors to lobbying firms to regulatory targets." In one case, even the federal government is paying rent to the president.

The Chinese government has granted Trump at least 39 trademarks, some of which had been previously rejected, since he took office; Ivanka Trump, the president's daughter and senior adviser, has also gotten at least seven since she joined the administration. It's good to be the king or in the royal family. Do you have the slightest clue what a trademark from China mean as far as monetary value? No, you don't have a clue, that's obvious.

Overall in 2017, Trump's companies sold more than $35 million in real estate ... mostly to secretive shell companies that obscure buyers' identities. Mysterious investors suddenly pouring tens of millions of dollars into Trump coffers once he became the Republican nominee and then the president? Nothing suspicious here: Please move along.

All this is just a small window into the graft and corruption that sits deep inside this man's presidency. Don't even try to compare trinkets and rugs that President Obama received with the millions upon millions of dollars Trump and his family has profited in an egregious, in-your-face type of corruption and thievery that this despot has drained out of this presidency.

No they are not a violation, not even close. Foreign dignitaries present presidents with gifts when they meet, and the president returns the favor in kind. It’s an important diplomatic gesture of any visit. Presidents can’t keep most of the gifts they get, Government regulations prevent any federal government employees, yes, including the president, from accepting gifts over $390. So there’s an entire diplomatic choreography around it. The “Protocol Gift Unit” quietly takes the gift and passes it onto the National Archives. The Archives in turn estimates the gift’s value, logs it into public record, and stores the gift for safekeeping. Many go into display in the president’s future library after he retires.

'Emoluments' such as those that Trump has been enriching himself and his family personally are not 'gifts'.
