In an effort to protect minors from accessing online pornography, Louisiana lawmakers have enacted a new law requiring age verification on adult websites.

Act No. 440, which went into effect on Jan. 1, will now require residents of the Bayou State to provide proof of their age with a government-issued ID or digital ID card before accessing online pornographic websites.

The act states that pornography is a public health crisis for younger viewers, citing that it “contributes to the hyper sexualization of teens and prepubescent children and may lead to low self-esteem, body image disorders, an increase in problematic sexual activity at younger ages and increased desire among adolescents to engage in risky sexual behavior.”

This could involve adults as well. So who gets interrogated or detained in case of a sex crime in LA? The cops will have lists of porn gazers as prime suspects.

So much freedom in Louisiana, eh?

What a stupid, dumbass law. Not only that, this is just asking for people's information to get stolen.

VPN's are about to become hella popular in Louisiana, and most certainly by the dumbasses in the Louisiana legislature that passed this through. Hell, probably even Bel Edwards.

Go fix the actual things wrong with your state.

Giving your driver's license to a pornographer sounds like a great idea.
This is being made to give your DL to the LASP. So next time sexual crime happens in your area, guess who winds up in a lineup?

I mean, we warned you.

The Federalist Society Court has no intentions of stopping at Roe, and red states mean to give them every last opportunity to throw out a bunch of objective-sounding bullshit to justify shoving certain brands of Christianity down our throats. I'm sure they'd be more than happy to massively strengthen what government can do in the name of fighting "obscenity" and the like.

One might wonder what else the state intends to do with the information that a particular citizen has visited a porn site.

"Hey there, sex police, I'm a'gonna look at me some porno!"

Yee haw.

This will not last long.

Bet they seize your computer & do a forensic search of your hard drive. Debbie Does Dallas might bring hard time in Angola with all the other lifers.

It will be interesting to see if this unfunded mandate is deemed to be Constitutional or enforceable for websites located outside of Louisiana.

I’m not super tech savvy, but this seems to require some (deemed to contain ‘too much’ porn for Louisiana) websites to alter their access permissions based on a given online user’s location being in the state of Louisiana.

Is this user location determined by the IP address or does it require accessing GPS data on the connected device? If the former, then use of a VPN service might easily defeat the law’s effectiveness.

Not for tech savvy folks even if it does.
There seem to be ways around this but it sounds like they intend to block major porn sites & the cops will be the only ones to hand out the passwords.

This may violate the First Am. & may wind up in court.

I think so as well.

Inmate 1: "Whatchu in here for? I'm here on armed robbery".
Inmate 2: "Assault with a deadly weapon. What about you, bro?"
Inmate 3: "Looking at online porn without an ID!"

Freedom of expression seems to include reading & watching what you want. It's like a library having a 'banned' section that you need ID to enter & read or watch.

Pornography[edit]

Further information: Pornography in the United States

U.S. courts have ruled that the First Amendment protects "indecent" pornography from regulation, but not "obscene" pornography. People convicted of distributing obscene pornography face long prison terms and asset forfeiture. However, in State v. Henry (1987), the Oregon Supreme Court ruled that obscenity was an unconstitutional restriction of free speech under the free speech provision of the Oregon Constitution and abolished the offense of obscenity in that state, although it remains an offense on the federal level.[68]

In 1996, the Congress passed the Communications Decency Act, with the aim of restricting Internet pornography. However, court rulings later struck down many provisions of the law.

In 1994, Mike Diana became the first American artist to receive a conviction for obscenity for drawing cartoons that were judged legally obscene.[69][70][71]

Child pornography is illegal in the United States. The U.S. Supreme Court has held that it is not protected by the First Amendment, and even if not obscene, it is not considered protected speech, according to New York v. Ferber.
