If you are a visitor to this country you are here on a "privilege" basis. If you violate the terms of that privilege you can and should have that privilege removed. The INA is an administrative act, not a criminal one so 5th and 6th Amendment protections don't apply and since there isn't anything unreasonable about removing a person that violates their visitor privilege then the 4th doesn't apply either.Your error is thinking this is about this one particular man.
