Democratic election lawyer Marc Elias told the Sun Sentinel that he thinks the undervotes were due to voting machines not detecting genuine votes. “I am pretty confident what you are going to see are markings that were not picked up by the machines or a calibration issue that was not registering that part of the ballot,” he said.

On Friday, there was more evidence showing that the design of the ballot in Broward County could explain why the Senate race—and thus Nelson—got proportionally fewer votes than they did in the rest of the state. The Sun Sentinel reported, “More than 24,900 Broward residents voted for Florida governor but not for U.S. senator,” and that the pattern of fewer votes in the Senate race than in lower-profile statewide races “appears in no other major Florida county.”

The reason for the vote gap could be that Broward put the Senate race below the instructions for filling out the ballot in the far left column, which violates established best practices for ballot design, according to experts cited by the Sun Sentinel.

The kneejerk anger and impulsive fury is predictable given Republicans took a big hit nationally on Tuesday. The Trump Train in the US House went off the rails and straight into a swamp. As votes are counted in close races the blue wave continues to get bigger which is how these things happen. D's are up to a 35 seat House gain and counting. Lots of red House seats that normally go for the Republican by 20 points went for the Democrat by one percent or less. This is indeed how it happens as we're seeing in red Arizona and elsewhere. This is what Republicans are looking at in Florida too. We just don't know yet so let's keep some balance and perspective.

That's more reasonable to say or claim.

It contrasts directly with posters who are accusing a Democratic party lawyer of being, well, a Democratic party lawyer. The right hasn't started rounding up D party lawyers yet to dump into stadiums but who knows. The right is saying too that a judge in AZ they don't like is unethical while leaning heavily on the FL judge who made what is likely to be a normative ruling.

The question of the odd undervote in the FL Senate race remains open at this point. We'll see about the Broward ballots in question through public scrutiny.

Palm beach county refuses to follow a court order to provide the Scott campaign with the total numbers of votes cast. There are 67 counties in Florida and Bourad and Palm Beach are the only two that consistently have problems following Florida voter law. Even the panhandle of Florida that just suffered a massive hurricane damage a month ago followed the law. 90 thousand votes have magically showed up in Bourad and Palm Beach county.

reports conducted by people with self interested motives. the political fallout of admitting there was systemic fraud in a major close election would be unbearable and so it's far easier to turn a blind eye. In this case we have an election official who is pretty much violating every law that was passed to prevent an environment where fraud is possible, so you can't claim it's not occuring is a self interested one.

Neither had the state’s Division of Elections, which weeks ago sent two observers to Broward to watch the elections process at Scott’s request.

Democrats, on the other hand, alleged voter disenfranchisement. Attorneys for Nelson conferenced with a federal judge in Tallahassee Friday afternoon hoping to preserve thousands of absentee and provisional ballots rejected due to discrepancies in signatures. The case remains alive, but the judge declined to extend the noon Saturday deadline for supervisors to submit their unofficial results to the state.

“This is a feature, not a flaw, of our Democratic system,” Nelson attorney Marc Elias said of the state’s ballot-counting and looming recount process. Elias, on a conference call with reporters, ripped Scott for asking a state agency to investigate the counting of ballots in a race in which he’s running. “This is not a third-world dictatorship. We don’t let people seize ballots when they think they’re losing.”

Brenda Snipes should have handed over the information when legally ordered to. And the republicans should allow ALL VOTES TO BE COUNTED. Right now all I've read is that a dangerous mob of republicans have descended on the election office and threatening to kill Brenda Snipes. Snipes should hand over the information and Rick Scott should stop inciting his mob to commit violence.

This is a normal wave election. When the challenger wins it's by something like one percent or by half that. When the party that's on the hook wins, i.e., Republicans, it's not by ten percent. In year 2000 for instance Republicans won by a very close vote of 5-4. And in that election nine voters got to vote twice, once in their home precinct and once at the office.

In Montana, incumbent Democrat Jon Tester is running neck and neck with Republican Matt Rosendale, with less than 2,000 votes separating the two. Tens of thousands of votes remained to be counted as of Wednesday morning, KRTV reported. (Update: On Wednesday the AP called the race for Tester.)

In Florida, Republican Rick Scott is running ahead of incumbent Democrat Bill Nelson by a margin of slightly over 50,000 votes. Scott claimed victory on Tuesday night, but Nelson’s campaign said it was waiting for all the votes to be counted (Decision Desk HQ has called the race for Scott). But the closeness of the race — more than 8 million votes were cast — may trigger an automatic recount; that would mean manual vote counting and close scrutiny of “overseas and military ballots, provisional ballots and vote by mail ballots that have defects such as a missing or non-matching signature,” the Miami Herald reported.

One governor’s race is still in play:

In Georgia, Republican Brian Kemp has a two-point lead over Democrat Stacey Abrams. Abrams did not concede the race on Tuesday night, and her campaign told CNN that it expects at least 77,000 more votes to be counted from Democrat-leaning districts. If Kemp ends up with less than 50% of the total vote (he currently has 50.6%) then Georgia law would require a runoff election between the two candidates.



There are still a number of House seats to be declared. Among them:

In California, where a bunch of races have yet to be called, Republican incumbent Dana Rohrabacher is running a little under 3,000 votes behind Democratic challenger Harley Rouda in the 48th District.

In Georgia's 6th District, in what could be one of the biggest upsets of the election, Democratic challenger Lucy McBath has a lead of fewer than 2,000 votes over incumbent Republican Karen Handel. (Update: On Thursday morning, McBath declared victory and Handel conceded.)


And in Maine, US election history could be made in a race where the candidates are currently separated by less than 200 votes: With both incumbent Republican Bruce Poliquin and Democratic challenger Jared Golden both hovering around 45% of the vote, the state’s new ranked-choice congressional voting system — the first of its kind in the nation — could be used to decide the race.

The system lets voters rank candidates in order, rather than just tick a box for one of them, and if no candidate secures more than 50% of the vote, people's second choice votes come into play. Such systems are used in democracies around the world, but it would be the first time such a vote has elected someone to the US Congress.

How is Rick Scott doing that, by insisting on a fair election and calling out those who openly flaut election law and come up with boxes and boxes of uncounted ballots and saying, "oops, we forgot to count these"?

People shouldn't be watching the NFL. I put my money where my mouth was. I quit cold turkey and I ain't goin back.

Snipes is in an elected position its the voters own fault if their votes don't get counted due to malfeasance or incompetence on Snipes part. We can't have 65 counties following the rules and two heavily democrat counties not following the rules. That gives them an unfair advantage. That is not equal application of the law.

Any counting should ALWAYS be done with observers from all sides.

well it's kind of hard to prove when the elections official in question flagrantly violates the law and destroys evidence, in fact has been convicted of said.
