If memory serves, it's established under law and managed by the judge.
What would you have them do, exactly?
Perhaps one day we'll get to protest at Fred Phelps' funeral with a sign that says GOD HATES FRED PHELPS or THANK GOD FOR A DEAD FRED.
He's not worth it.
Don't know if he's a con artist because I have no interest in studying how he finances his activities, but he's definitely a hate monger from all I can see.

What you see is merely an act. People do some messed up things for money. Some sue Asian dry cleaners into the poor house over a measly pair of pants. Some run around suing fast food places even though its clearly the fault of their client for spilling coffee on themselves or shoving one too many cheeseburgers in their mouth. Some sue homeowners because their client while in the commission of a crime injured themselves on the homeowner's property and injured themselves. Some kill for money. Some people force others into the sex trade in order to use them to make money. The Phelps clan deliberately pisses off grieving families in order to get those grieving families and or cities to violate the rights of the Phelps clan. Every funeral protest to that family is a fishing expedition. If it was no profitable for them then they would not be protesting at different funerals.
