Law enforcement obviously gave the judge bad info for the warrant. Was it because their intel was bad or out of date? Regardless, under the color of law, the officers are liable. Here is the relevant federal statute:


Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

Did you miss the part of the 4th amendment where the officers are required to swear under oath that the info given to the judge who issues the warrant is truthful? Obviously, the info given the judge was not the truth. Therefore, the warrant was not valid, the search was not valid, because the people and their stuff were not living there any more.

The ICE thugs terrorized this law abiding family, trashed their house, and stole their stuff.

This is unfortunate, but you forgot to tell us why this mistake was made? Was it corrected when they realized there was a mistake made? The nation is overrun with millions of immigrants who illegally entered the country and that is a felony, a crime and one that in many cases can end in immediate deportation even without what many would claim was lack of due process, but that's the law.
Under certain circumstances, including being apprehended near the border and within a short timeframe after entering the country, undocumented immigrants can be subject to expedited removal. This process allows for immediate deportation without a formal court hearing.
  • Individuals who already have a removal order in place, such as those who missed a court date or were previously found deportable, may not be granted a new hearing before being deported.

  • Asylum seekers must make a formal request for asylum within the first year they are in the country.
It’s not a felony to enter illegally. A misdemeanor.

Generally speaking the threshold is "true to the best of my knowledge" but I could be mistaken and the requirement may well be "beyond a shadow of a doubt". I mean, maybe things have changed and you now need a full hearing before a judge can issue a warrant.

Absolutely! Criminals should ALWAYS be proved guilty in a court of law before ANYONE is allowed to investigate them. That's in the Constitution!

We are talking about unreasonable and unsubstantiated searches due to some apparently overzealous ****s not making sure they have their facts together before traumatizing innocent people.

The warrant had names listed. They knew the minute they went in they had the wrong family and still proceeded to violate this family’s rights. She told them they had JUST MOVED IN

Oh, yeah, and they have been told the stuff ICE took (their phones, etc) would be returned in a few weeks. Even though they were established as not being suspects of any kind.

They were not given contact information, not even a business card.

It's worse than that. In practice, it means they can only be sued if they act outside of their charter.

However, it does NOT shield them from criminal charges, just lawsuits.
