Your definition of rape

What is you definition of rape?

I know this shoulds like a really stupid question but I'm listening to a radio interview right now where apparently a British politician stepped in a big pile of it by saying a high profile figure (the Wikileaks guy, Julian Assange) couldn't have raped the lady in Sweden he's suspected of sexually assaulting because of an earlier consensual sexual encounter that evening. The discussion later expanded to include hypothetical situations where on party was sleeping.

I'll reserve my opinions for later, but apart from consideration of the Wikileaks matter, how do you define "rape"?

Forces non-consentual sex. (A different standard though for children).
 
Honestly, I go even further-- it's any sexual activity in which informed consent is not present. If you're lying to them about something, over which they would choose not to have sex with you, that is also rape.

And yeah, rape can certainly occur within the boundaries of an established relationship and even marriage.

I'll go with the FBI definition:

Definition
Forcible rape, as defined in the FBI’s Uniform Crime Reporting (UCR) Program, is the carnal knowledge of a female forcibly and against her will. Attempts or assaults to commit rape by force or threat of force are also included; however, statutory rape (without force) and other sex offenses are excluded.

I copied your post, Viktyr, because putting lying in the equation doesn't cut it, in my opinion. If we're going to prosecute "rape victims" because their sexual partner lied and said he was single when he was married, that just completely waters down what rape really is.

Good point. However I would consider someone a rapist is they willingly tricked a blind or otherwise deceived woman into going to bed thinking it was her husband/partner. A few years back I saw a report of a situation where a roommate brought home a one night stand from a poorly lit nightclub. Everybody is half drunk. He got up and to use the potty, got disoriented and ended up in the roommate's bed. Her boyfriend was spending the night but crashed on the couch. She initially thought it was her own boyfriend but almost right away after things got physical she knew it wasn't him and got hysterical, understandably. IMHO she was raped but I think the perpetrator was legally innocent because he honestly thought it was the other lady. Moral of the story: is alcohol really that important? And you shouldn't bring home strangers to sleep with, especially if you have a roommate. Anyhoo, he stood trial. Not sure of the outcome.
 
I'd say the FBI definition doesn't go far enough, because it fails to include the occasion of rape committed against a male.

Exactly. Clearly males can be and have been raped.

Any sexual act performed without informed consent is rape. If the victim is unconscious or sleeping, there is no informed consent and it is rape. If the victim is mentally incapable of giving informed consent, it is rape. If the victim says "stop" at any point during the act, and the aggressor (of either sex) does not stop, it is rape. If the victim says nothing, but has been threatened by a weapon or by bodily harm if he/she resists, it is rape.

Pretty simple, in my opinion.

A dear friend of mine was raped during his first semester at college. He tried to press charges and got all but laughed out of the police station.

I'm sorry to hear that. Males who have been sexually assaulted are definitely the victim of discrimination, not just by law enforcement but by society at large. :(
 
Rape is forced sex... nuances can be discussed, but it always comes back to forced sex.

Yeah, and a woman can pretend I'm Brad Pitt, too, but they're still going to make a Lifetime Movie of the Week out of it. Just because someone's attractive doesn't mean you're going to want to tap it.

So once you have sex with a woman she is forever your sex slave? She is your for fornication until you tire of her? Don't think so.

EDIT: Actually fornication means consensual sex so I guess I meant she is yours to f***.

I agree. To me it seems more like fraud than anything, and legally I think one might be able to sue civilly under fraud statutes.

I absolutely agree; and I'll go further and say I think it's an excellent idea. These men and women who wreak destruction in their casual partners' lives by lying about their marital status and their fertility status should pay the piper. Civil action. Perfecto!
 
Rape to me is having sex with someone who does not consent or cannot consent (like with date rape). Consent must be given in every instance, it's possible to rape your spouse in my opinion. Also, continuing with sex when the other person asks you to stop is also rape.

I haven't given my definition of rape yet, only asking if being in a relationship where sexual activity s a given like marriage should require new expressions of consent each time. I'll go ahead and say this much, if were married and my wife wanted to surprise me before I woke up in the morning and without asking started having fun to which I awakened to, I would be thankful despite the fact that she never got my consent first. I certainly wouldn't call the police and press charges. I'd probably take her out to dinner that night and buy her flowers to show my appreciation.

It was a man, yes. But women can coerce men into sex and/or force an erection through use of medical means. Granted it's likely harder to sexually violate a man than a woman from a mechanics standpoint, but it isn't impossible.
