A draft memo from the Office of Management and Budget (OMB) is raising the possibility that furloughed federal workers may not be entitled to back pay from their time off during the government shutdown.

An administration confirmed to The Hill that the memo, which was first reported by Axios, hinges on an aggressive interpretation of the Government Employee Fair Treatment Act of 2019, which President Trump signed during the last government shutdown.

The OMB memo argues the law does not automatically guarantee that all furloughed employees are guaranteed back pay. It cites a line in the amended version of the law, which states that furloughed workers will receive back pay “subject to the enactment of appropriations Acts ending the lapse.”

Republican Sen. Thom Tillis (N.C.) on Tuesday strongly criticized the White House budget office for circulating a draft memo indicating that furloughed federal workers may not automatically receive back pay when the government eventually reopens.

“I think it’s a horrible message to send to people who are basically hostages right now to the Democrats shutting down the government, not agreeing to a clean [continuing resolution],” Tillis told reporters. “I think it’s bad strategy.”

When asked about it at the Oval Office Tuesday, President Donald Trump said that while the administration has a keen interest in taking “care of our people,” “there are some people that really don’t deserve to be taken care of, and we’ll take care of them in a different way.”
