What should be done to Americans caught being ISIS members by US Forces

What should the US military do to Americans serving with ISIS

Sixty minutes is currently interviewing some London based scum bag who is a radical islamist who has been charged with recruiting for Isis and admitted to supporting jihad against the west. This report noted that one of the ISIS thugs who beheaded an unarmed western victim had a "london accent"

what should be done to americans captured by US or allied troops fighting against ISIS?
 
I personally think they should be killed on the spot- not captured.

It's probably the only legal action. Is there a law in the US they could be charged with?
I think I remember that it used to be that an American citizen who served in the armed forces of another country was in jeopardy of losing his citizenship. Is that true? Not that it's relevant in this case.
 
I don't see how they would be spies unless they were working for our government and sending ISIS information.

If an American were found fighting for ISIS inside, say, Iraq, he should be handed over to the Iraqis. It is their country.

If an American is found inside the US actively assisting ISIS, then he should be prosecuted inside the US for assisting a criminal organization. What would we do with an American who was assisting one of the powerful drug cartels from inside the US?

if they are captured by US troops its pretty assured they are fighting against the US but I see your point

lts suppose they are firing on British or Canadian troops but a US special forces platoon captures them?
 
If it cannot be proven they'd taken up arms against the US or allies, strip them of citizenship and give them a plane ticket to wherever they want to go. If they did take up arms, hold them as POW's until the war on terror ends.

If captured on the battlefield and are not wearing the uniform of a sovereign state, execution by musketry.

Any American who's waging war against America or an ally should be tried by a military court for treason and if found guilty, execution by musketry.
 

we would be hard pressed to find any muskets in the army's armory though in say Afghanistan, such weapons might well be available.
