John Kerry is right, open ended clauses and the interpretation of them by our SCOTUS are a problem to a better nation/society/world.
Lots to fix in our system...pardon power, SCOTUS ethics, impeachment/removal, 2A, etc., are in many cases open-ended to the point they don't work nearly as well as they could, if they were properly bounded.
Presidential immunity too...shamefully Trump showed us that's broken too.

Once that's fixed, we could fix gerrymandering, money in politics...maybe get some digital privacy, electoral college...

It's a real problem having gone from credible journalism, news outlets, papers, credible organizational, to a digital free-for-all where anything goes.
I think in some ways it's too late, it can't be fixed because the issues we have, ultimately will prevent those fixes...

It's not really all that quiet, it's a problem. It's only tricky because some people have been swayed by "The Constitution is perfect!!" because they don't think much. Public officials always have to remember that many people are not just poorly informed, but misinformed.

So you do not think the first amendment should be a block? What exactly is your issue with someone saying the first amendment limits what the government can do?

That’s a flimsy Strawman. The OP didn’t state Kerry said to get rid of it.
 
In Germany, because of German history it’s illegal to do the ‘Heil Hitler’. That would not be allowed here, because of the 1A. Is Germany less or more free than the United States? I would argue more free, in the sense that their people have a greater chance at social mobility. Ours do not, but may ‘Heil Hitler’ if they please. You tell me which is the smarter society.
 
Well, it is. Freedom's are often a double-edged sword.

The same right a person has to create and spread lies is the same right that allows us all to speak freely.

I think the bigger problem is the gullible Trump cultists who knowingly and willfully accept and defend all the lies and misinformation they are fed through their rightwing propaganda outlets. Not much different that a flat-earther, I suppose. But flat-earther's are generally treated kindly in a "bless your heart" kind of way. Those who propagate the Trump cult line of propaganda are ripping this nation apart. And they do not care. They piss on your leg and tell you it's raining. You cannot legislate human decency and intelligence. One guy's "insurrection" is another guy's "peaceful protest." No act of congress can fix that.
 
This is the new, regressive left. They like to mock "freedumbs" as they attempt to make autocracy cool again. Just imagine how much "change" they could accomplish if they could just instill that Ministry of Truth they desire so much to go along with the stacking the court and Biden's one-man mandates to bypass Congress.

Come on. He was clearly implying that the First Amendment was an annoying nuisance for what he would like to do.

Are you saying Americans would have more social mobility if we banned Hitler salutes? What connection are you drawing between these two very different topics?

No, Germany does other things that would be deemed “less free” by American standards. But, “more freedom” isn’t by definition a good thing.

How about we do away with all electrical codes for construction.

More freedom is better, right?

More freedom is better when it comes to not censoring "misinformation." Yes.

If you want to take the illiberal side of the debate, then just own it instead of doing this motte-and-bailey where you advocate for other, totally unrelated things like electrical codes or social mobility.
 
I would rather be lied to by someone than have my voice taken away by the Government or anyone else.
