WASHINGTON (Reuters) - The U.S. Supreme Court on Thursday released a report on the May 2022 leak of a draft version of its blockbuster ruling overturning the 1973 Roe v. Wade decision that had legalized abortion nationwide, but failed to identify who was behind the disclosure that rocked the nation's top judicial body.

The leak - with the news outlet Politico publishing the draft ruling on May 2 - prompted an internal crisis at the court and ignited a political firestorm, with abortion rights supporters staging rallies outside the courthouse and at various locations around the United States.

It was an unprecedented violation of the nine-member court's tradition of confidentiality in the behind-the-scenes process of making rulings after hearing oral arguments in cases.

The report did not identify a specific source of the leak, which amounted to an extraordinary breach of protocol at the court. But it concluded: "Whether or not any individual is ever identified as the source of the disclosure, the court should take action to create and implement better policies to govern the handling of court-sensitive information and determine the best IT systems for security and collaboration."

Because conservatives wanted to make the leaking of the decision more important than the decision itself. That is, until it became highly probable that it was a conservative justice who did the leaking. Then it was "Um.....never mind."

Every single aspect of this issue has been dealt with by conservatives in bad faith.

We know that Alito leaks decisions to lobbyists, and we know that Thomas, who refuses to recuse himself in cases where his wife is involved, has the ethical and moral compass of a fire ant. Thomas literally said that he would spend his life on the SC making liberals' lives miserable. It is extremely reasonable to think it was either of them.

They say they do not know who leaked but obliquely point the finger at those who supported upholding Roe v Wade.

I agree with you, but have to say the phrase "extremely reasonable" to be quite hilarious.

That's like being a 'little bit pregnant".

As I said, I think it was Alito. You think it was Thomas or his wife. One of us is right.

I'm shocked, shocked to find that there is gambling going on here.

I doubt my posts are still available to view from the period around Dobbs and the leak but I said it then. We will not get a definitive answer because it is likely Alito or somebody that clerks for Alito.

Chief Justice John Roberts made a huge mistake in allowing the Sumpreme Court Marshall and internal police to conduct the investigation. They didn't have the manpower, the resources nor the experience to get to the answer. Just down the road was the best investigative service in the world. FBI. I wonder why they didn't use them? Maybe he was worried as to what they would find.

I'm not so sure.
Particularly controversial decisions such as over turning 50 years of supreme court precedent usually occur at the end of the term- when the justices are free to escape DC.

I don't know what potential benefit could have been gained by Alito, or other members of the majority, in leaking this opinion months before the final opinion was to be released.

Also, everyone seems to skip over the fact that each of these judges have multiple law clerks assigned to them. And while they too are sworn to secrecy, they all have access to these opinions from the minute the first draft is circulated.
