The last few years of war have resulted in the Ukrainians not being even remotely close to being able to try and take Crimea.

The bulk of the people there aren’t interested in being part of Ukraine.

Recognizing reality is something the US should be doing more of.

Oh really? The fact the Ukrainians aren’t anywhere near capable of retaking Crimea, and the bulk of Crimeans don’t want to be a part of Ukraine at this point, doesn’t reflect in America’s decision making?

I just answered that. Not eloquent, but it doesn’t change the basic facts on the ground motivating said decision.

Clearly Crimea is Russian lingua franca, street signs in Russian, annexation was done without firing a shot, and Crimea is historical Russian

I get the West is pathetically incompetent at diplomacy, but issuing ultimatums doesn’t work when you can’t back them up.

So what are you arguing? That the US should join the ICC or that it shouldn't?
The pretense that the US doesn’t fully subscribe to the ideology of “might making right” is rather laughable.
 
And membership in the ICC is the sole criteria for coming to such a conclusion?
If the US actually believed in, like, even half of what it claimed to, those responsible for the extensive list of war crimes it committed would have been held accountable.
