Not only has the federal Department of Education failed in the asserted noble goals alleged for its creation and has used money taken from American citizen paychecks to fund sexual deviant indoctrination of their children, but federal taxing and spending for today’s federal Department of Education is an outrageous violation of the defined and limited grants of power found beneath Article 1, Section 8, Clause 1 of our Constitution, for which Congress is authorized to lay and collect taxes.

Let us look at the facts.

Prior to the adoption of our existing Constitution, the People of Maryland delegated the power for a state funded and regulated educational system to their state elected officials, and not to a national governing power --- the wording being as follows:

“The General Assembly, at its First Session after the adoption of this Constitution, shall by Law establish throughout the State a thorough and efficient System of Free Public Schools; and shall provide by taxation, or otherwise, for their maintenance.”

The Maryland Constitutional also states, in emphatic terms:

“the People of this State have the sole and exclusive right of regulating the internal government and police thereof, as a free, sovereign and independent State.”

In fact, under Art. 3 of Maryland’s Constitution, the command is for local regulation and funding of education as opposed to a federally funded and regulated public school system!

The Maryland Constitution also states:

“The powers not delegated to the United States by the Constitution thereof, nor prohibited by it to the States, are reserved to the States respectively, or to the people thereof.”

This very provision of Maryland’s Declaration of Rights is also agreed to by the People of the United States by their ratification of the Tenth Amendment to the Constitution of the United States!

Now, with respect to our federal Constitution and its delegated powers, upon researching the record of the Constitutional Convention of 1787, we find Delegate Charles Pickney, on August 18th, proposed a broad power "To establish seminaries for the promotion of literature and the arts and sciences", but this proposal was rejected by the Convention in favor of a limited grant of power expressed in Article 1, Section 8, Cl.8, of the proposed constitution. The limited power, later agreed upon by ratification of our Constitution authorizes Congress "[t]o promote the Progress of Science and useful Arts” . . . (and what is authorized to accomplish this?). . . by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries."

The fact is, the federal Department of Education and its current functions are in defiance of the defined and limited powers granted to Congress. And every time a member of Congress votes to tax and spend on this agency, they are committing a fraud upon the people of the United States and are usurping a power not granted!

Thank you, President Trump, for keeping your promise and working to close down the dastardly evil federal Department of Education which has turned into an institution of sexual deviant and radical political indoctrination of America’s children, rather than education.

Why have a written constitution approved by the people if those who it is meant to control and regulate are free to make it mean whatever they want it to mean?

For too long, the Department of Education has used blue state tax dollars to keep roofs on red state schools. It’s time for this to come to an end. We should abolish the Department of Education and let red states fend for themselves.

That sounds nice, but those impacted are too young to vote. Punishing those not at fault is a terrible idea.

Perhaps, but too many of their parents thought they would use my tax dollars to teach their children, then vote against my interests. Now they will learn that elections have consequences, and they will have to pay out of pocket for their own schools.

Do you have loved ones that use DOE programs for loans and grants for higher education? Or anticipates using DOE programs for loans and grants? Too bad because your vote just screwed it all up.

Wow, you sound like Trump. Maybe you should work to change that.

I don’t think MAGA can have “loved ones” per se, since Donald expects 100% of their love. It may be more accurate to use the singular and ask if their loved one uses DOE programs. Of course the answer from @johnwk is likely no, Donald does not use DOE programs.

Elections have consequences and Nebraska and Oklahoma need to realize that.
Neither Nebraska or Oklahoma are sentient beings, they are states. They cannot realize anything. Those states however are filled with people, many of whom did not vote for the current administration, but would be impacted by your vindictive hatred.

It seems that, according to your criteria, a significant portion of our government departments may be operating outside the defined and limited powers assigned to Congress. While I support a substantial reduction in the Department of Education, I am not entirely convinced that it should be completely abolished. This hesitation stems from my uncertainty regarding which entity or agency would take on the responsibility of deciding who receives assistance and in what amounts.

Those states are filled with people who voted for this or couldn’t be bothered to vote. Now they get to enjoy the consequences of their decisions. I see no reason why I have to be the one to bail them out. They have incomes, they have state governments. Use them. Fund their own schools. Stop relying on people like me to do it for them.

Who paid for the California fast train that hasn't seen a single foot of track for over a decade. U.S. taxpayers. All of them. California is a enormously mismanaged state fiscally.

Education clearly needs to be reinvented and due to conflicting local requirements and priorities I don't think that can be done on the national level.

370k Nebraska voters voted for Harris, in Oklahoma it was half a million. Maybe you should have worked harder for your preferred candidate instead of blaming others.

So everyone else is at fault. Even though is 100 % of the voters in those states had voted for Harris, she still would have lost. Try logic instead of pure emotion when debating. It works better.

Guess you never heard of the "blue dot"!! But I guess I still need to be punished because people out in the western part voted for it.

Nah I'll just blame you.
I blame all democrats, which includes myself. I should have made more effort, and should have been more effective in supporting my preferred candidate. If all us democrats had convinced just one person each, we would have won the election.

You watch way too much FOX.

The biggest indictment of the Dept of Education is that since its inception, our education system across the country has turned to shit. Entire school districts, especially in the majority minority communities have completely failed...not hyperbole...they are graduating people that cant spell their own name. There are school districts where in the ENTIRE SCHOOL DISTRICT they cant find a single student...not one...that can pass both a basic English and math competency exam. We spend more on education per student than anyone else in the world and we have some of the worst results in the developed world. At BEST you would have to say the Dept of Ed is incompetent and inefficient. At worst...complicit.

So...chop it down. End the taxation for that department and let states and local governments take responsibility for funding and content.
