This Cannot Be a Possibility, Wut?

Technically Rand Paul is not wrong.

The Constitution does not explicitly say that the Speaker of the House must be selected from those elected to the House, Section 2 "The House of Representatives shall chuse their Speaker and other Officers; and shall have the sole Power of Impeachment." All that is really required is that the person is nominated by someone in the House, and by vote obtain the majority of the full membership of the House.

Unorthodox and dangerous? Yes.

But is possible and passes the Constitution? Also, yes.

So what this really comes down to is the likely shit show of someone like Musk being Speaker of the House. And it would be a complete mess of dysfunction.

Musk could be SOTH, but would not be 2nd in line to the presidency. He is not a natural born citizen, thus he is ineligible to be in the line of succession.

Nope! Only the President and Vice President need to be eligible to be President. If anyone further down the line of succession needs to serve as president but is ineligible, they are just skipped over and it goes to the next person in the line of succession.

The 12th Amendment. It specifically applies the same eligibility requirements to the Vice Presidency which apply to the Presidency: "But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States."

However, all subsequent positions in the line of succession are just there by statute rather than by constitutional mandate, and have no such constitutional limitations for their office-holders. A number of those positions have been held by people who are themselves ineligible for the presidency, including the current Secretary of Homeland Security, Alejandro Mayorkas.

No, they can be speaker anyway. If the situation arises, the line of succession just skips them if they aren't eligible.

Agree. Musk is not a natural born citizen and therefore ineligible to be president, the speaker must be eligible for the presidency, Rand Paul should know this. Perhaps he is sucking up to Musk for another reason.

No, only the VP has to be eligible for the presidency.

In the scenario where the Speaker is the next in the line of succession, they just get skipped if they are not eligible.

I have referred to Musk as president elect in a few posts, as soon as it happens in the national press a couple times the friendship will be over.
 
He could be made speaker, but in the event of the loss of the VP, he could not become VP due to amendment 12, so it would pass on to the next guy.
I was not aware that was a possibility, I thought the speaker had to meet all presidential qualifications.
