COLUMBIA, Tenn. - A Tennessee District Attorney told WHNT the man believed to have kidnapped 15-year-old Elizabeth Thomas could walk away with only a misdemeanor.

Investigators have repeatedly said it doesn't matter if the teen willingly left with 50-year-old Tad Cummins.


"If she comes back and she is absolutely adamant that this is all voluntary, her own doing, that he didn't touch her, it's going to be difficult to prove that," said Cooper.


"Our kidnapping statute says in essence through it's silence on that issue. It's saying that you can be between 13 and 18 and you can legally make the mature decision to leave your family and run off with a person never to be seen again," said Cooper.

I think the federal government often oversteps its authority. But crimes that cross state lines legitimately fall under federal jurisdiction.

Yep. It's why the feds were called in to hunt down all those bank robbers back in the 1920s and 1930s since they crossed over state lines so much.

Yes, in Tennessee... the minute they stepped over state lines... and ended up in California, federal law steps in. Federal law does not currently allow for taking children from one state to another without the written consent of their parents.

Game? Set? Match?
 

It's a federal matter. No one cares what Tennessee thinks at this point.
