States, cities sue U.S. to block 2020 census citizenship question

April 3, 20118

NEW YORK (Reuters) - A group of U.S. states and cities on Tuesday filed a lawsuit to block the Trump administration from asking people filling out 2020 census forms whether they are citizens. The lawsuit, filed by 17 states, Washington D.C. and six cities, challenged what it said was an "unconstitutional and arbitrary" decision announced last month by the U.S. Department of Commerce, which oversees the Census Bureau, to add the citizenship question. The census, authorized by the U.S. Constitution and conducted every 10 years, is used to determine the allocation to states of seats in the U.S. House of Representatives and to distribute hundreds of billions of dollars in federal funds to local communities. Critics of the citizenship question say its inclusion might dissuade immigrants, and perhaps many citizens, from being counted, with a disproportionate impact on Democrat-leaning states.

The plaintiffs include many Democrat-controlled or leaning states, major cities including New York, Chicago, Philadelphia and San Francisco, and the U.S. Conference of Mayors. Supporters of the question, including Commerce Secretary Wilbur Ross, say it will help the country enforce the landmark Voting Rights Act of 1965. A citizenship question has not appeared in the census since 1950. At a press conference, New York Attorney General Eric Schneiderman called the question a "blatant effort" by the Trump administration, which he said has an "anti-immigrant animus," to prevent the Census Bureau from "carrying out its clear constitutional mandate."

The critics are right. The 2020 citizenship question is a purely political maneuver (to disenfranchise blue states) rather than a true demographic necessity.

Heck, it would be nice to know how many illegals are really sucking the life out of our nation and stealing resources that could be better used by our own actual citizens...

Maybe they'll just reduce funding based on estimates then. Anyone here ILLEGALLY should not be counted, IMO.

Article 1, Section 2 of the United States Constitution says nothing about citizenship as a qualifier. All "free persons" are to be counted.

That is such a lame excuse and the ignorant people are gobbling it up.

Why would citizens be dissuaded? And immigrants? (I like how they refuse to use the word ILLEGAL!) They lie and spin as much as anyone else.

If you are here illegally, how can you be considered a free person?

good. the question is only there to scare legal immigrants into thinking that the census is an ICE tool so that they won't participate due to fear for their families and friends.

They've already clarified that it's not to be used as an ICE tool.

How does a legal immigrant participating in the census effect their family and friends. That doesn't make sense.

So, if you knew your friend was illegal, you would not participate for yourself? It's not asking if you know any illegals, just asking if you yourself, are a citizen.

I think that's invalid reasoning. All the lawmakers in those states need to do is inform the illegals (they do it all the time about other things) that it's not a problem, and they'd fill out the Census.

But, any good census will tell us who is and who is not a citizen.

it's an extension of voter suppression tactics. add in the question, and a significant chunk will say **** this. that's the strategy.

yes, i'm sure that lawmakers will eagerly ensure that everyone is informed. lol

Fine, demand they answer the question and put them in jail if they are not here legally, then rip up their census form since they are no longer "free persons"

"Free persons" are not people on the run from the law.

yep, just like the DACA dat. well, take a look at the tRump administration memo on the availability of that DACA information:
“Information provided to USCIS in DACA requests will not be proactively provided to ICE and CBP for the purpose of immigration enforcement proceedings, unless the requestor meets the criteria for the issuance of a Notice To Appear or a referral to ICE under the criteria set forth in USCIS’ Notice to Appear guidance,” said the statement.

In other words, USCIS (United States Citizenship and Immigration Services, the agency which handles DACA) won’t proactively give immigration enforcement officers a list with the names and addresses of all DACA recipients. But if ICE officers ask for it, the agency will provide it.

so, why would illegals worry that their honest answer to a census question about being illegal might be used to their own detriment sarcasm alert.gif

Excellent point!!

Agreed, we can use IRS data to count US taxPAYERS and their legal dependents instead.

The Constitution demanded a count every 10 years because no one had a SSN back then.

We can now simply add up the SSNs on Tax forms and call it the census and save a bundle.

Taking the census is an executive branch function and Trump is free to take the count the best and most efficient way he can.

I'd like to know the number of former children illegally brought to the US by undocumenteds if DACA is ever considered.

Too bad. If they don't want to take the time to answer one extra question, that's on them. So instead they want to not have the question, so states get more federal funds aka taxpayers money, than they are entitled to AND more political representation. Yup, that sounds fair.

I'll go for that.
