The judiciary is a co-equal branch of Government.
The government has three branched: The Judiciary, the Executive and the Legislature
(you're floundering no by repeating meaningless phrases, you usually go off on a tangent, when cornered, about the defense clause being general and welfare clause common. or something)
But, to repeat my post, that you seem incable of answering:
Where is this "Common Law" that you say obligates people to serve in the militia
And if a citizen refuses to serve, under what statute would he be prosecuted ?
And if you're confusing "common law" with the Constitution, where in it (including the 2nd amendment) does it say that service in the militia is obligatory ?
The 2nd amendment is a prime example of how ambiguous the Constitution is. The Constitution doesn't apply to people Btw, no individual has ever been prosecuted for violating it.
Do you still think arming convicted criminals and pressing them into service as our armed guards, constitutes either "wellness" or "well regulated" ?
Who makes up the militia, is it just male citizens of military age ?
Are the weapons that people keep and bear issued by the militia (as makes sense) like the Swiss used to do ?
What is an "ORBAT"
What does an "appeal to/from ignorance" mean ?
It now seems that such is you lack of understanding, you now actually think that there's a difference between "to" and "from".
