Oklahoma Pols Want a Database of Everyone Who Has an Abortion

An Oklahoma bill that would create a database of every person who obtained an abortion is one step closer to becoming law.

The so-called Oklahoma Right To Human Life Act, authored by state Rep. Kevin West, passed out of the Public Health Committee last week and moves to a full House vote next month. The bill would require the Oklahoma State Department of Health to create a database in which each patient is identified by a “unique patient identifier” to track how many abortions a patient has and when. That information and the identity of the patient could be released to authorities under a court order.

Oklahoma already outlaws all abortions except when necessary to save the life of the mother, without exceptions for rape or incest.

Tamya Cox-Toure, executive director of the ACLU of Oklahoma, said the law could discourage patients from seeking abortions during a medical emergency and discourage doctors from performing them.


“People who are ending their pregnancy for medical reasons—to save the health of the pregnant person—are the people who are going to be part of this database,” she told The Daily Beast.

“Even in a situation where ending the pregnancy saves the life of the pregnant person, there's still a lot of stigma that happens,” she added. “So the idea that a patient is forced to give this information goes against doctor-patient confidentiality as well as patient-informed consent.”

Obviously this is done so they can legally challenge every abortion that happens for medical reasons.
 
Well. If that is to be the case....

Then the potential fathers-to-be should be included on this list. Since this is just to "track" medical reasons for abortions like causes of death, it would be prudent to know who the potential fathers are since sometimes the reasons for the medical emergencies may have to do with genetics from men that are passed onto the unborn. And they should have a unique identifier in case that is the cause.

Also, it would be good to know to make sure that they were informed and had given consent to the abortion.

"That section of the bill's intent is to specifically target the over the counter items that are not always safe for everybody," West said about moving certain contraceptives to prescription status instead of keeping them over the counter.

Both Republicans and Democrats on the committee, including the women who sit on the committee, all voiced concerns about various parts of the bill despite in the end allowing it to move forward after a vote that fell along party lines.

"I believe there is an opportunity for tracking women. I believe there is a major privacy issue that we should be concerned about not just women but men too," said State Representative Trish Ranson (D-Stillwater).

"You do know that IUDs are used for other conditions outside of preventing pregnancy right?" asked State Rep. Cynthia Roe (R-Lindsay) who is also a registered nurse.

Even men on the committee expressed concerns with the language about possible government tracking of patient medical records.

West said his bill was written in partnership with the conservative legal defense fund Alliance Defending Freedom, and he said after hearing committee members concerns on multiple sections, major changes to the bill would need to be made. He said he was open to addressing both Democratic and Republican concerns before the bill reaches the full House chamber next month.

What gets me is these fine Americans demand a database of people who have had abortions, but refuse to allow a database of gun buyers. And they claim to care about "protecting life".

It is a public safety issue, protecting the born.

Potential for gun crimes to be solved faster. People don't like to report theft of a firearm out of their unlocked car. Police are investigating a murder using a 25 caliber.
A database like the one N.Y. has serves up number of owners and their descriptions. When contacted, some cannot account for their weapon of record because they
neglected to report theft.

Regarding 3 - your gun is not equivalent to your body. So while I can see objecting to either/both - you’re comparing apples and gorillas.
 
Not a HIPPA issue. This is a state health department.
States have to follow federal law.

HIPPA protects the privacy of:

Individually identifiable health information" is information, including demographic data, that relates to:

  • the individual's past, present or future physical or mental health or condition,
  • the provision of health care to the individual,

What Oklahoma is requesting is protected under HIPPA.

That's nice and all, but both databases would be a violation of one's right to privacy.

Motorists are held responsible criminally and civilly if they leave their vehicle running and it is stolen and then used in a crime. The stolen vehicle has a registered license plate and VIN number. Are you saying it is unconstitutional to hold gun owners responsible for reporting loss of possession?
