New York judge grants Trump request to file motion to dismiss charges, cancels sentencing indefinitely

Judge Juan Merchan on Friday granted President-elect Trump's request to file a motion to dismiss the charges in New York v. Trump and removed the sentencing date for the president-elect from the schedule.

Judge Juan Merchan on Friday granted President-elect Donald Trump's request to file a motion to dismiss the charges in New York v. Trump and removed the sentencing date for the president-elect from the schedule.

Merchan said Trump attorneys have until Dec. 2 to file their motion for dismissal. Merchan said Bragg has until Dec. 9 to respond.

Merchan also confirmed the stay in sentencing for Trump, which was requested by both Trump's and Bragg's attorneys. The sentencing was scheduled for Nov. 26, but on Friday, Merchan said that date "is adjourned."

The best part, indefinitely and the even more important distinction is that Trump is not a convicted felon. That's sure to chap more than a few hides if Bragg agrees.

Indeed. And the truth is, it was only illegitimate Democrat lawfare that branded him a felon in the first place.

True, but no one seems eager to take on the hot potato of sentencing a sitting president. What will be interesting are the arguments to dismiss the case, because thus far the previous attempt to dismiss outright failed. Whether or not there's some reduction of charges so they're just the falsifying business records which is just a misdemeanor. The weakness of this case was the fact it was a novel legal theory, not that he didn't falsify the records.

Give it a rest. Merchan ruled he will never sentence Trump, so he will never be convicted. Your lawfare failed.

Lawfare is a lie MAGAs chant to turn Trump into a perpetual victim. He copped charges for crimes he was committing, nothing more.

that is a BIG WEAKNESS,, Bragg never wanted to file in the first place. Then that dude wrote a book and the dubious "novel theory" was born

Granting a request to file a motion is not a victory, tho I think eventually these convictions will be overturned.

This is a chant the WeHateAmerica crowd jabbers whenever anyone dares deny the WEHA mantra.

The WEHAs have been attacking Trump ever since he descended the escalator and dared to challenge their illegitimacy in power. Corrupt, power-hungry, and viciously malicious - the Democrats have done everything in their power to destroy Trump, even to the point of assassination.
