Michigan AG Says Sidney Powell’s Claim that ‘No Reasonable Person’ Would Believe Her Kraken Theories Is Exactly Why She Should Be Sanctioned

“These attorneys seemingly made statements they knew were misleading in an effort to further their false and destructive narrative,” [Michigan AG Dana Nessel] wrote in a statement on Wednesday. “As lawyers, fidelity to the law is paramount. These individuals worked to further conspiracy theories in an effort to erode public trust in government and dismantle our systems of democracy. Their actions are inexcusable.”

“If there were any doubts about counsel’s mindset when filing this action, Ms. Powell has put them to rest—she and her co-counsel knew there was no reasonable basis for the statements they made in this litigation, but they made them anyway,” the brief continues.

Reached for comment, [Attorney Sydney] Powell supplied a terse statement in an email to Law&Crime: “‘Horsefeathers’ and another political publicity stunt.”

She is misrepresenting what Powell was saying, but what do you expect from an AG who threatens to disbar and even criminally prosecute any attorney who files a case about election fraud. I’d like to clarify what actually was presented to the court. First, let me be clear: any suggestion that “no reasonable person” would believe Ms. Powell or her comments on the election is false. The language these reports referred to is a legal standard adopted by the courts to determine whether statements qualify as opinions which are exempt from defamation liability.

As the DC Circuit reaffirmed just last week, there is no claim for defamation when the alleged “defamatory” statement is a legal opinion. Ms. Powell’s statements fall precisely into this category. Ms. Powell reviewed sworn affidavits, declarations, expert testimony, and other highly corroborated evidence concerning the election which Ms. Powell filed with the courts and shared publicly. She continues to stand by those opinions today. Our motion, in part, argues that the Dominion case should be dismissed because legal opinions are not grounds for defamation.

In sum, the legal standard of a technical legal defense crafted by the courts has been improperly manipulated by the media to tell a false narrative. Ms. Powell is not backing down or retracting her previous statements concerning Dominion. Dominion’s case lacks legal merit and should be dismissed in its entirety.

Her defense comes down to her admitting she lied. If she really disagrees with her lawyer on that defense, she has every right to reject it. And guess what? She's not. So she'll be under oath saying her claims about voter fraud were lies.

Again, if she doesnt want to accept that defense, it's her choice...but has she changed it?

- Still waiting for her to produce the sever that was taken in Germany that was used to manipulate the votes in the 2020 election. This sever seemed to be able to connect to stand alone machines that had no capability to connect to the internet or intranet.

You seem to misunderstand how libel and/or defamation laws work. The person making the claims can say things that are "outrageous", such as "Coca Cola company has resumed putting coke into their drink products." which is an outrageous claim. However, if someone, such as Tucker Carlson or Rachel Maddow puts this out on their show, they can be sued for defamation because despite how ridiculous such a claim is, it would still be a claim that is possible to prove or disprove, but that could cost the company money, cause outrage.

What is going on with Powell, is she is trying to say that because they think it is "outrageous" that means others shouldn't have believed her, but that is not how the world works, and she and the judges know this. That is not at all a sound defense. If she truly thought no "reasonable people" should have believed her, then she wouldn't have filed a case in court because you have to get your case past "reasonable people" in a courtroom. But by simply saying something is "outrageous", does not mean that they believe people would not believe her. Reasonable is still pretty subjective. And Powell, by filing her suit(s) in court obviously believed reasonable people would believe her.

She has no evidence to actually support her statements. By claiming she does, she shows they were not merely opinions.

Perhaps you should look again at the requirements to prove slander in court. It is not necessary that the person/company it is said against would believe the accusation. Of course the person suing for slander is not going to believe the accusation against them, feel that it is "outrageous" because they know what they have or have not done.

How is she "misrepresenting" what Powell said? It was pretty clear to me what Powell said. Powell hoisted herself on her own petard!

I totally agree! She did everything she could to put herself on the legal disbarment chopping block. Any sane, rational and politically astute person watched this all unfold with shock and disgust and can see the necessity to take Powell to task for her actions.
 
Why is anyone defending her? She said a bunch of crazy stuff and that crazy stuff happened to be accusing a company of some bad stuff. She hasn’t provided a drop of evidence to back anything she said. Now she will be punished for that. What is there to defend?
