Kilmar Abrego Garcia on way back to US to face criminal charges: Sources

Ya, if the Trump Administration had complied with 8 USC 1231 back in 2019 we wouldn't have this problem.

Once the Immigration Judge had found against asylum, and then placed the hold on deportation to El Salvador - all the Trump Administration had to do was identify a 3rd country that would voluntarily take him, then go back to the Immigration Judge and get the hold lifted.

They decided to do nothing and in fact issued Abrego Garcia legal authorization to work.

Do repeat, the Trump Administration could have deported him in 2019 but chose not to do anything.

Completely agree, but point of order, the authority to deport to a 3rd country is limited. Indeed, it has often been done in contravention of US law, but more often by voluntary relocation.

There are also treaty issues (that seem to be being ignored, here) that prohibit such removal. This is especially true of those being sent to El Salvador's CECOT facility, which are blatant violations of both federal law and international law, in addition to constitutional violations.

    This section allows the DHS to disregard the designated country of removal and seek removal to a third country if it is "impracticable, inadvisable, or impossible" to remove the non-citizen to the designated country.

One regular hearing. One appeal and a removal order that prohibited removal to Guatemala, not El Salvador.

Now, because Xinis thinks she's the ultimate authority in government, he gets to come back here to get a criminal trial too. When he's found guilty all the removal stuff will STILL apply and he'll still end up deported. That's one heck of a "win" for ya!

A federal grand jury found that the 29-year-old was an MS-13 member who transported thousands of undocumented immigrants, including children, from Texas to states across the country for profit for nine years. He allegedly also transported firearms and drugs, abused female migrants and was linked to an incident in Mexico where a tractor-trailer overturned and killed 50 migrants.

 
Great. Xinis will get the case and she will, in her authority as some judge, grant him citizenship ad expunge his record. DoJ will appeal and everything she did will be tossed. Garcia, if we can still find him, will be rounded up and deported again but at least all the liberals will be happy that they accomplished nothing in all of this.

American voters are tired of you mostly peaceful protests and your backing of criminals. This scum bag will be convicted of crimes and hopefully sent back to El Salvador and not our prison.

Such high level crimes that were not brought before; so strange and oddly convenient. This was such a high level crime that neither the THP nor the FBI thought to have him and the others arrested, yet now there's a case against him.
