WACO, Texas (AP) — Justice Brett Kavanaugh says the genius of the American system of government is that no one should have too much power, even as he and other conservatives on the Supreme Court are facing criticism for deferring repeatedly to President Donald Trump.

Invoking the list of grievances against King George III that the nation’s founders included in the Declaration of Independence, Kavanaugh said Thursday the framers of the Constitution were set on avoiding the concentration of power.

WACO, Texas (AP) — Justice Brett Kavanaugh says the genius of the American system of government is that no one should have too much power, even as he and other conservatives on the Supreme Court are facing criticism for deferring repeatedly to President Donald Trump.

In rare interviews with NBC News, a dozen federal judges — appointed by Democratic and Republican presidents, including Trump, and serving around the country — pointed to a pattern they say has recently emerged:

Lower court judges are handed contentious cases involving the Trump administration. They painstakingly research the law to reach their rulings. When they go against Trump, administration officials and allies criticize the judges in harsh terms. The government appeals to the Supreme Court, with its 6-3 conservative majority.

And then the Supreme Court, in emergency rulings, swiftly rejects the judges’ decisions with little to no explanation.

Emergency rulings used to be rare. But their number has dramatically increased in recent years.

Ten of the 12 judges who spoke to NBC News said the Supreme Court should better explain those rulings, noting that the terse decisions leave lower court judges with little guidance for how to proceed. But they also have a new and concerning effect, the judges said, validating the Trump administration’s criticisms. A short rebuttal from the Supreme Court, they argue, makes it seem like they did shoddy work and are biased against Trump.
Judges on both side of the aisle are starting to see this Supreme Court as nothing but some rubber stamp for Trump.

They are using these emergency rulings called the "shadow docket" to effectively rule without providing much in the way of explanation and allowing them to just make shit up and do what they want
Before the recent surge, most emergency cases involved death row inmates’ attempts to block their executions at the eleventh hour, and the court would normally handle them via terse orders with no explanation. But the increase in cases in hot-button nationwide disputes, sparked in part by presidents of both parties relying more on executive orders than passing legislation via Congress, has put greater scrutiny on the court’s reasoning.
 
For those inflicted with TDS, any agreement with Trump is met with distaste and criticism. Like Trump can NEVER be right.
 
Presidents in general have gathered FAR too much power, mainly due to Congressional dysfunction, but more recently due to Supreme Court decisions.

I despised Biden and his abuses, such as student loan forgiveness. And I despise Trump's abuses.

The Presidency has been far too powerful for far too long. Dating back to Lincoln and with both parties doing their best to further expand Presidential power.

The Presidency needs to be neutered.

Congress needs to reclaim its prerogatives. All laws allowing the President to declare "emergencies" need to be examined and the vast majority need to be repealed. All laws granting the President authority to unilaterally levy tariffs or enact any other form of protectionism need to be repealed.

If Congress has appropriated money, the President should be required to actually spend that money in accordance with the Congressional appropriation. No refusing to spend appropriated funds.

As for the greater Executive Branch, I would require that Congress must vote up or down on approving all Executive Branch regulations, creating a body of "administrative law" that would be subordinate to regular statutory law.

And if the Supreme Court refuses to reconsider its misguided and flawed decision to grant the President virtually total immunity, I would move to amend the Constitution to explicitly strip the Presidency of immunity. It should be like South Korea. If a President of any party has committed a serious crime or breach of public trust, he should be able to be arrested and dragged out of the White House if necessary.
 
And if the Supreme Court refuses to reconsider its misguided and flawed decision to grant the President virtually total immunity, I would move to amend the Constitution to explicitly strip the Presidency of immunity. That was the most mind boggling ruling. I'm not sure how in any way that ruling should exist based on anything the founders had said or alluded to.

A supreme court that rubber stamps everything the next democratic president does wouldn't be an issue for you, eh?
I don't see any rubber stamping going on. I see Supreme Court Justices making reasonable rulings that just happen to chap your ass.

It is mind boggling.

The Constitution provides exactly two privileges, both for Members of Congress only.

From Article I:

Section. 6. The Senators and Representatives shall receive a Compensation for their Services, to be ascertained by Law, and paid out of the Treasury of the United States. They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.

1. They are privileged from arrest in civil matters. Of little import today as civil arrest is exceedingly rare.
2. Their speech and debate is privileged.

NOTHING in the Constitution grants the President so much as a shred of immunity. On the contrary, the fact that he must swear an oath explicitly makes him civilly and criminally liable for violating that oath, including all acts and omissions committed as President.

Justices and Judges are clearly not privileged. The recent case of Samuel Kent, who was convicted and in jail, while still collecting his Article III Judicial salary for several months, before he was finally forced to resign under threat of impeachment.

The case granting President's immunity was wrongly decided and needs to be reversed.

Critics see the SCOTUS doing it's job and don't like that the rulings don't fall on the left side. So of course the court is wrong and fascist.
