The courts would. Patel is an moron. He would simply squander DOJ resources and force defendants to spend money against malicious prosecution. He would do exactly what the MAGA folks here erroneously claim Trump prosecutors have been engaged in.

Then why all the talk of preemptive pardons and concern of a 'hit list' prepared by Kash Patel?
If charges are not sufficiently supported, the accused will be acquitted.
If you don't like out judicial system, might I suggest Russia, China or perhaps Saudi Arabia?
