Judges spar with Democrats, DOJ in impeachment doubleheader

You do realize that the Constitution was signed before we had a criminal code? And you also realize that the only thing the Constitutions says about impeachment is the "House has the sole power of impeachment?"

It's says "bribery, treason, high crimes and misdemeanors" too.
 
But you guys say that no crimes are needed to impeach. Why would you say that at a time like this? If you think the president committed crimes then there is no reason to say this at all.

Oh please. It's in response to House Republicans complaining that Trump hasn't been charged with a violation of the criminal code. But of course you already know that.

I know that if Trump committed no crimes then he shouldn't be impeached. And I know that Democrats want more witnesses because they impeached a president with no evidence of crimes, which is why they need more witnesses. If they had enough evidence of crimes to impeach then they wouldn't need more witnesses. Even you just admitted there are no violations of the criminal code so this is nothing but partisan politics.

There was one within the last month or so. Don't recall the details, but the judge issued a scathing hundred-some odd page report. Trump's attorneys made the argument that if Trump shot someone on 5th Avenue, he could not only not be prosecuted, but that he couldn't even be investigated because of "absolute immunity." The judge wasn't happy.

Perhaps you've heard that many of these decisions are being appealed and will land in the SCOTUS. That alone tells you Trump is losing his court cases.

Anybody remember how the Repubs on this forum are constantly ranting about the Dems not going to the courts before starting the impeachment process? This past Friday's (Jan 3) hearings will tell us why using the courts has not been a favourite tactic for Congress. Two lawsuits filed last year - before the impeachment hearings began - have not gone before the bench for the third time and still, no final decision has been made. The losing side following the upcoming rulings will then be appealed to the Supreme Court.



For the 'conservatives' who argue/believe the Dems should have gone to the courts from the very beginning of this mess, I offer the response from the DoJ's attorney, Hashim Mooppan:
"The court should not be refereeing who’s right or wrong about whether the president is acting totally unusually or Congress is acting totally unusually."

So, what's the solution? The attorney representing the House had an interesting idea

2. Sharing information isn't a campaign contribution. It's literally protected by the 1st Amendment.

Most conservatives that I have read on here never said anything about Congress using the courts.

Most of what I have read from the conservatives on here was about congress being petty when they brought obstruction of congress charges into the game after Trump petitioned to courts to review his case about congress subpoenaing his cabinet.

Trump was well within his right to petition the courts for a ruling.

?! The obstruction of justice charges go to ordering witnesses to keep quite, scrubbing documents, threatening others for talking, and harassing entire departments for complying to Congressional inquiries. Trump's behavior has been about ordering others to prove their loyalty to him over country. Conservatives don't get to rationally whine about something he so obviously did. Especially, considering that they impeached Clinton for lying about getting a blowjob. Lying about that was obstruction and this was the sole charge. Trump has actually gone out of his way to dare people to criticize him for his obvious obstruction. He did the same thing with the Mueller case, in which he obviously got lucky. And none of it has to have a thing to do with Trump filing a petition.
